KY AG to defend KY Unclaimed Life Insurance Benefits Act

Kentucky families deserve to have case heard before Supreme Court, Andy Beshear says

FRANKFORT, KY - (Thu 11 Feb 2016) – "I was outraged to learn yesterday that the Kentucky Department of Insurance had turned its back on thousands of Kentuckians and their families by refusing to defend the Kentucky Unclaimed Life Insurance Benefits Act, which requires insurance companies to notify heirs when a policyholder passes away. Despite serving as the state’s chief lawyer, my office was not consulted by the Department. Rather, the Department acted in a highly unusual manner, dropping a fully briefed case at the last minute. Because of the Department's reckless actions, this may be an uphill battle, but if the Department of Insurance is going to abandon its duty to protect Kentuckians, the Office of the Attorney General is going to step in. - Attorney General Andy Beshear

She had made a profession of faith in Christ, and was a homemaker. She was born in Center, Metcalfe County, KY, was a resident of Jefferson County, KY, at the time of her death, and will be laid to rest in her native town. She was the daughter of the late Floyd London and Lora London. She leaves 13 direct living descendants.

George Morgan, 73, Casey County, KY (1942-2016)

Michael Regan responds to Mr. Beard

Michael Regan writes:
To whom this may concern; I want to center my opinion on item no.3 of Mr. Beard's editorial. The crux of his point seems to be that our young citizens will be drinking and, therefore, should be taught to do so with moderation. Where is the other side of the story? Is it not a better path to a teach them what the Bible actually advocates; that fermented drinks lead the soul away from a relationship with the Lord? They open the door to loose character and suggestive influence. Who does anyone know that has added one moment of lasting value to their lives by drinking alcohol. If such a crutch is needed for relaxation or socialization, then there is certainly a need for introspection. What does that person need in their life to be at peace with who they are without a drug like alcohol? Remember, it IS a drug, and a very powerful one, at that. Thank you. I say vote yes to alcohol sale. Myself as most of citizens of Adair county has went out of the county to purchase alcohol. On, my way back I didn't drink and drive. I did not drink till I was drunk. Yes, it would be easier to buy from the county in which you live. One way or the other if you want to drink your going to get it one place or the other. I will vote yes, and, yes, I have children. In response to Doug Peterson's commentary, I would like to provide the attached statistics concerning Alcohol Related Collisions in Kentucky as well as Pulaski Co.

Statewide from 2000-2014, many counties and cities in Kentucky voted to allow legal alcohol sales in some capacity. Those counties and cities are noted on the statewide graph. You can see a significant downward trend in alcohol related collisions statewide.

Author's Note: This is a very in-depth discussion of "wet" vs. "dry" as this issue will be on the ballot in March. It's lengthy in nature but I hope you will read it in its entirety. I recognize that this is a very personal decision and I respect the views of all parties. HISTORY: The Failures of Prohibition
Many social problems have been attributed to the Prohibition era. Mafia groups limited their activities to prostitution, gambling, and theft until 1920, when organized bootlegging manifested in response to Prohibition. A profitable, often violent, black market for alcohol flourished. Powerful gangs corrupted law enforcement agencies, leading to racketeering. In essence, Prohibition provided a financial basis for organized crime to flourish.

Personal commentary

While Chris may have good ideas, they are flawed. While most people who consume alcohol in our county go out of county to purchase, many many more illegally purchase alcohol from our neighborhood bootlegger.

Alcohol consumption in the county will rise significantly if the county is wet, since it would be much more available. More alcohol does mean more problems.

Kenneth Owen Rush, 51, Adair Co. native (1964-2016)

Joyce Owen Twyman (ACHS 1958) writes: Ken opened the Walmart in Adair County, KY, and always considered Columbia part of his home due to his grandparents (Mr. and Mrs. Roy Owen) and me being from there. I have lost a wonderful loving son and my heart breaks.

Kenneth Owen Rush, 51, passed away on February 9, 2016, in Bowling Green, Kentucky. He had a super smile. He was warm and inviting to all, but ready and willing to tell you the truth. He loved sports and traveling. He was a family man who loved talking about his children. He was a loyal friend. "Kenny" will be missed.

Ken's funeral service will be held at 10amCT, Saturday, February 13, 2016, at J.C. Kirby & Son Lovers Lane Chapel, 820 Lovers Lane, Bowling Green, Kentucky, 42103.
