PSC finds appointment of Larry R. Bryant to CAUD board void

Statutory limit for Fiscal Court to make the appointment had expired, PSC finds. Now the Public Service Commission will accept nominations for the vacant seat for 20 days from the date of the Order, November 18, 2015. The final appointment of the new member will be made by the PSC.

The long awaited ruling on the appointment of Larry Russell Bryant to the Columbia Adair Utilities District board of trustees has been decided today, November 18, 2015.

The Public Service Commission has declared that a vacancy exists - effectively meaning the appointment never was - and will allow nominations to take place within the next 20 days from any person who wishes to nominate a candidate to fill the vacancy.



The order finds that the apppointment of Larry Russell Bryant, appointed by out-going CJE Ann Melton and approved by Adair Fiscal court, was invalid because statutory requirements were not met. Adair Fiscal Fiscal Court did not make the appointment within 90 days term of CAUD Commissioner Rudy Higginbotham ended on August 1, 2014. Kentucky statutes provide that the court could have had to make the appointment no later than November 1, 2014.

The approval of Mr. Bryant was made on December 9, 2014, more than a month after the court's the statutory right had ended. By Kentucky law, the authority to make the appointment had passed exclusively to the Public Service Commission.

The order by the PSC was sent to Adair County Judge Executive Michael Lee Stephens, who had made the PSC aware of the situation, today.

Now the question of who will join Chairman Tim Baker and members David Jones, Barry Stotts and Mike Newton awaits a decision of the PSC.
