Comment on status of CAUD Board Member Larry R. Bryant The status of Columbia/Adair County Utilities Board member Larry Russell Bryant has been drawn into question because when the appointment came, in December of 2015, it was no longer the prerogative of Adair Fiscal Court, which had 90 days from the expiration of his predecessor's - Rudy Higginbotham's term - to name a replacement. After that it was up to the Public Service Commission to fill the vacancy. CJE Michael Stephens has notified the Public Service Commission and the matter is now in their hands. A reader writes on questioned status of CAUD Board member: "All of this chaos might have been avoided if the water district had just complied with the law and properly performed its duty. KRS 74.020 Section 4 states vacancies shall be filled be the same appointing authority which is empowered to make the original appointment. ...a vacancy resulting from the expiration of a term...shall be filled by the Public Service Commission if, within ninety (90) days following the vacancy, the vacancy has not been filled by the appropriate county judge/executive with approval of the fiscal court. "Then in the same statute in Section 9 (a) states within thirty (30) days of the occurrence of a vacancy on its board of commissioners resulting from the expiration of a term ... a water district shall notify in writing the Public Service Commission of the existence of the vacancy."CJE Mike Stephens said that in his latest conversation with Bryant he had informed him of his status. It is his understanding, Stephens said, Bryant still intends to be at the Special Called Meeting, Tue 18 Aug 2015, at 8amCT, and that Bryant intends to vote.
