CJE Mike Stephens has sent letter to PSC on CAUD member seat Validity of Larry Russell Bryant's appointment to the Columbia/Adair Utility District board is now in the hands of the Public Service Commission. Judge Stephens has drafted a letter to the Public Service Commission. The PSC is expected to name a replacement for Bryant, he said. By Ed Waggener Adair County Judge Executive Mike Stephens, contacted at his office this morning about the status of Columbia/Adair County Utilities District Member Larry Russell Bryant, said that he has been in touch with the Public Service Commission about the situation. Judge Stephens said that he was told by the Public Service Commission to send a letter outlying the circumstances of the situation, and he said, "They told me they would take it from there." Judge Stephens said that the KRS appears to be clear to him that he has had other legal advice since, that the Fiscal Court's right to name a person to replace Commissioner Higgbotham was 90 days after the term expired. After that, the appointment is to be made by the Public Service Commission. It is his opinion, he said, that Mr. Bryant is not a duly appointed member at this time. He said that the PSC had informed him that he had acted as he should, in letting them know, as soon he knew of the problem, and they, the PSC would take it from there. After learning of the situation which would shift the balance of power on the board to 2-1 with one abstention, if Chairman Baker continues to oppose re-submitting the original Stotts Construction contract to the PSC.
