The vote to appeal Judge Vance's ruling: 2-0 On the potentially substantial fees to be borne by Fiscal Court, CJE Michael Stephens says it is something Fiscal Court has no choice in: 'We'll deal with it.'The vote was 2-0. Only appointed officials Billy Curry, the Republican Party representative, and Ben Loy, the Democratic Party Representative on the Board, voted to appeal. By Ed Waggener Yesterday the vote to appeal was given, as 3-0. Adair County Judge Michael Stephens called to let us know that actually the vote was 2-0, with only the appointed officials, Ben Loy (D) and Billy Curry (R) voting to appeal. Deputy Adair County Sheriff B.J. Bray did not vote. Adair County Court Clerk Lisa Greer and Adair County Sheriff Harrison Moss did not vote. Lisa Greer, did not vote because she had not been a member of the Board of Elections during the November 2014 election. Sheriff Moss was a member, but could not take part in the proceedings because he was a candidate. Judge Stephens said that while the cost for the appeal is unknown at this time, that the county at this time is obliged to pay the outside attorneys basic fee, which he understood to be in the $4,000 range, plus hourly fees and other charges, that is a responsibility the county will bear. "We'll just have to deal with it," he said. Our thanks to Judge Stephens and to all who help maintain the accuracy of CM. - ED WAGGENER This story was posted on 2015-04-23 04:15:28
