Ray Bardin questions submission to CM on waterway rights Questions whether waterways can be fenced for livestock or not Ray Bardin writes: I'm confused. Your submission states if it floats then its a public right of way but if it touches ground it is trespassing. Are you sure that is an accurate statement? You also state it is legal to fence a creek in order to water livestock, but aren't you then fencing a public right of way?
