Adair Co. Fiscal Court meeting June 14, 2011 report

In last night's Adair County Fiscal Court meeting, a lengthy Executive Session ended at 9:30pmCT, with a quick call back to regular session and a just as fast motion to adjourn by the two Magistrates who moved the court go into secret meeting, Seventh District Magistrate Billy Rowe and Fifth District Magistrate Billy Dean Coffey.

No announcement was made about hearing, and only one witness was called to the session, County Road Superintendent Jobe Darnell.

Conjecture was that the session was yet another attempt to "get" Darnell, but it failed.



The Road Superintendent is one of the most highly respected county employees. His department is regularly praised for its superior performance.

Court approves Road Work

Adair County Road Superintendent Jobe Darnell's road report was approved unanimously, 7-0, on a motion by Sammy Baker (3), seconded by Harold Burton (1).

Magistrate Sammy Baker gave high praise to the performance of the road crew, which is now concentrating on one District every two weeks. Magistrate Baker's District 3 was the chosen district recently and he endorsed the plan to improve logistics by putting equipment in one district at a time.

Court votes unanimously to buy Bush Hog

Superintendent Darnell asked for and received court approval to buy a new Bush Hog. The court approved the purchase of the machine from Columbia equipment dealer Hobdy, Dye, and Read, for $12,395 on a motion by Sammy Baker (3), seconded by Perry Reeder (4).

FEMA wavering on Bridge reimbursement

Judge Melton told the court that FEMA has initially rejected the county's claim for approximately $113,000 for replacement of the Purdy-Sano RD bridge over Sulphur Creek.

Judge Melton said the negotiations look favorable, but the outcome is still not definite.

The claim was rejected by FEMA on the grounds that the old bridge, made unsafe by the May 2010 flood, had not been inspected by State Bridge inspectors.

Reading of Roads

With no action taken, the request to close Rick Rod RD failed after several opposed the request at a hearing.

First reading for the removal of Needmore RD in District 3 from County Maintenance was approved 7-0, on a motion by Magistrate Sammy Baker (3), seconded by Magistrate Daryl Flatt (2).A first reading for the removal of Quinn Hollow RD in District 6 was approved, 7-0 on a motion by Joe Rogers (6), with a second by Sammy Baker (3).

Adair 911 Addressing and Mapping Coordinator Justin Bailey presented the reading of the roads.

Bailey reported that a grant application to Walmart for two new computers for the 911 Center had resulted in the gift of one computer. He and Judge Melton thanked Walmart for their continued support of the 911 center.

Court gives Cub Scouts $200

On a motion by Magistrate Billy Rowe (District 7), seconded by Magistrate Sammy Baker (District 3), the court voted 7-0 to give $200 to Cub Scout Pack No. 888 toward a trip to Lost Sea, near Sweetwater, TN, later this summer.

In making the motion, Magistrate Rowe indicated that a part of his motion would include a cessation of donations to non-governmental groups, but when pressed to re-state his motion by County Judge Ann Melton, he withdrew the phrase calling for an end to all donations.He was joined in the unanimous vote by Magistrates Harold Burton (1), Daryl Flatt (2), Perry Reeder (4), Billy Dean Coffey (5) and Joe Rogers (6).

Cub Pack 888, which now has 16 members, is at present the only scout unit in Adair County, Phillip Richard, a spokesperson, said.

Jail report approved

The court approved Adair County Regional Jailer Rick Wilson's report by a vote of 7-0. Wilson reported an increase in net billings of $10,488.10 over April 2011 net billings, with the increase coming largely because of a dramatic increase in the number of state inmates housed here. Mr. Wilson said, later, that the county's break-even point seems to come when there are approximately 25 state inmates, and approximately 100 total inmate population.

He told the court that Restricted Custody inmates had provided a total of 3,046 hours, valued at $24,368.0 in free labor to the Adair County Recycling Center, Adair County Road Department, Green River Animal Shelter, Center on Aging, City of Columbia, Breeding Fire Department, the Adair County Board of Elections, and for landscaping the Adair Annex.

Judge Melton thanked Jailer Wilson for the marked improvement in the jail facilities and for the landscape work at both the Adair Annex and at the Jail.

An agenda item to approve an application for a Homeland Security grant was postponed after Jailer Wilson reported that court endorsement would be needed only if the grant application, which he has already made, is approved.

County Sheriff Harrison Moss reported receipts in May of Franchise taxes

County Sheriff Harrison Moss reported the receipt of $88,935.23 in May for franchise taxes.

His 2010 tax settlement was approved 7-0 on a motion by Billy Dean Coffey, seconded by Perry Reeder.

Magistrates deny payment for Alice Stephens bill

After questioning by Second District Magistrate Daryl Flatt, the court voted 5-2 not to pay a $500 bill from Alice Stephens in the Adair County Sheriff's Office for preparing the Sheriff's office's preparation of the County Tax Settlement of the 2010 taxes.

Magistrate Flatt asked if whether the report were prepared on the clerk's own time or during office hours. Sheriff Harrison Moss said that he was unaware of the claim, and could not answer the question.

Magistrate Sammy Baker moved that claim be paid this year, with the subject being revisited next year. His motion received a second from Magistrate Harold Rogers, but on the roll call vote, only Baker and Burton voted to approved the claim. Magistrates Daryl Flatt, Perry Reeder, Billy Dean Coffey, Joe Rogers, and Billy Rowe voted against.

Judge Melton said that the bill had been paid in prior years as requested. She said that as County Court Clerk, she had prepared the Clerk's office settlement herself, with no billing for the service.

She had, however, approved a similar bill for County Finance Officer Gale Cowan in the County Judge's office.

Court order approved

The court unanimously approved a court order approving a pass-through check to Adair County Ambulance Service in the amount of $11,00917 for Senate BIll 66 money. The vote came on a motion by Joe Rogers (6), seconded by Sammy Baker (3).

County Treasurer's report approved

Adair County Treasurer Barry Corbin reported a May 31, 2011 reconciled balance in all county funds of $841,947.36. His report was approved 7-0 on a motion by Magistrate Billy Dean Coffey, seconded by Harold Burton.

Necessary budget transfers were approved unanimously, as well.

Barry Corbin unanimously approved for new 4-year term

The court unanimously approved the reappointment of Barry Corbin for a new 4 year term as county treasurer, at his present salary of 891.66 per month, on a motion by Sammy Baker (3), seconded by Daryl Flatt (2).

Corbin has held the job since the first year of Judge Melton's first term, when he was appointed to complete the unexpired term of Larry Dudly, who resigned.

1st reading of budget approved

The court approved a first reading of the Fiscal Year 2010-2011 Budget Amendments on a motion by Joe Rogers (6), seconded by Sammy Baker (3). The amendments were necessary because the county had received more revenue than budgeted.

Judge Melton called a special meeting for Thursday, June 30, 2011, at 3:30pmCT, for a second reading and to do any last minute payments necessary before the new fiscal year begins on July 1, 2011.

Burton Car Care & Recycling wins vehicle bid

Bids were opened on the sale of surplus county vehicles, with bids coming from Greer Construction Co. and Burton Car Care & Recycling (Sherman and Sherman Wayne Burton).

With bids of $1,051 for a International Dump Truck, $401.50 for a 1999 Chevrolet Lumina, $406 for a 1994 Chevy Caprice, and $456 for an Astro Van, Burton Car Care was deemed the low bidder and awarded the bid. The vote came on a motion by Billy Rowe, seconded by Perry Reeder, with all seven magistrates joining in the vote.

Bid awarded to Asphalt Materials for emulsified asphalt materials.

Bids were opened on an invitation for emulsified asphalt materials with Asphalt Materials, the present supplier, receiving the award on a unanimous vote following a motion by Billy Dean Coffey, seconded by Billy Rowe.

Hudson Materials represented by Garland Hoskins of Casey County presented the second low bid, and was the only other bidder.

Chris Janes new member of Airport Board

The court approved the appointment of Chris Janes to fill the unexpired term of Columbia/Adair County Airport Board member Doug Campbell, who resigned. Janes is Constable of District 4.

The vote was unanimous on a motion by Perry Reeder, seconded by Sammy Baker.

Jerry Franklin reassigned

Jerry Franklin, who had been a temporary full time employee during the illness of Adair County Solid Waste Coordinator A.L. Sinclair, asked to be reassigned as a part time employee of the center. Sinclair is now back on the job. The request was approved by a vote of 7-0 on a motion by Joe Rogers, seconded by Harold Burton.

Jerry Nixon hired part-time in CJE office

The court voted 7-0, on a motion by Perry Reeder (4), seconded by Joe Rogers (6), to approve the hiring of Jerry Nixon at $8.50 an hour as a part time employee in the County Judge Executive's office. She will replace Patty Nall, who resigned.

Minutes Approved

The court unanimously approved minutes for the May 10, 2011 meeting, and approved 6-0, the minutes for the Special Called Meeting of May 20, 2011. Magistrate Billy Rowe, who was not present at the May 20, 2011, meeting, abstained in that vote.

Barry Corbin gets new term as Adair County Treasurer

Adair County Treasurer Barry Corbin was unanimously approved for a new four-year term as County Treasurer at the Tuesday, June 14, 2011, regular monthly meeting of Adair Fiscal Court. Corbin has been treasurer for 4.5 years. He was appointed very early in CJE Ann Melton's first term to fill the unexpired term of Treasurer Larry Dudley, who resigned.
