AG Jack Conway announces Do Not Call judgment

From Commonwealth News Center

Attorney General Jack Conway Tuesday, November 23, 2010, announced a consent judgment against several defendants, including Michael Plambeck and Newburg Chiropractic, P.S.C. of Louisville, for violations of Kentucky's Do Not Call law.

Plambeck, Newburg Chiropractic, Cane Run Chiropractic, P.S.C. and their telemarketing firm, Media Placement Services, Inc., violated Kentucky's Do Not Call law and Telemarketing Fraud statute by phoning numerous Kentucky consumers on the Do Not Call List after the consumer was involved in a car accident.

The calls were made from July 2002 to April 2008 to solicit a "free" chiropractic exam.

"This agreement should send a clear message that there are consequences for failing to follow our telemarketing laws," General Conway said. "My office recognizes and protects the right of our citizens to avoid constant and often intrusive telemarketing calls. My Office of Consumer Protection will continue to investigate violations of the Do Not Call Law and to protect Kentucky families and consumers."

The consent judgment enjoins defendants from violating the Consumer Protection Act including any misrepresentations of their identity or the cost of any exam. The defendants have also agreed to pay the costs of investigation and attorneys' fees in the amount of $45,000. The agreement was entered Friday, November 19, 2010 in Jefferson Circuit Court by Judge Mary Shaw.
