Adair Fiscal Court meeting, Oct. 12, 2010 report

In last night's meeting:

In last night's Adair County Fiscal Court Meeting, a historic decision was made to ban smoking in all county owned buildings.



The vote was 5-1, with Magistrates Sammy Baker (2) Billy Dean Coffey (5), and Joe Rogers (6), joining Magistrate Wid Harris (2), whose motion to ban smoking drew a second from Magistrate Danny Goodin (1). Only Fourth District Magistrate Perry Reeder opposed the measure. Magistrate Terry Hadley was not present at the meeting.

The ban will take effect January 1, 2011.

The vote followed a presentation by Jelaine Harlow of the Adair County Health Department, who made a short presentation to the Court which cited medical evidence of the danger of second hand smoke, savings to the court on health insurance and maintenance. Because citizens may have to enter county buildings at times to pay taxes, or get licenses, it was unfair to them to be subjected to second hand smoke.

Harlow said that recent surveys by the department, at the Outdoor Expo this year and at the Westlake Regional Hospital Health Fair indicated that 72% of Adair Countians are non-smokers, 28% smoke.

In voting for the ban, the magistrates did not include any provisions for building outside smoking patios, as have been provided in some jurisdictions.

Buildings affected include the Adair Annex, the Historic Courthouse, the Adair 911 Center, and the county highway and recycling centers. The Adair Regional Jail and the Class D Facility were already smoke free, as required by State Law.

But Court takes no action on Zoning

Fourth District resident Mary Phelps appeared before the court asking to be on the November 2011 agenda to present solutions she has found for the problems related to the counties lack of zoning, but found herself in a position the idea of smoke free buildings would have been 20 years ago, where Civil Rights was 60 years ago, and where the idea of women voting was just over 95 years ago. The court apparently was not ready to discuss the the issue.

Judge Ann Melton told the Magistrates, after hearing the request, that she didn't think the court was ready for it. "We haven't even been able to agree on a nuisance law," she said.

None of the magistrates present spoke up for a discussion of the matter, including Judge Melton's November 2, 2010 opponent, Wid Harris.

Phelps cited the the changes which take place on previously pristine areas when relatively uncontrolled construction of mobile homes takes place, how it will stymie outside investment if those who move to Adair County and invest in property and adequate development rules aren't in place.

On the other hand, Jan Weber, a newcomer of some 30 years, said that she understood Phelps' frustration, but said that she moved here, in part, because of the lack of ordinances. She said that Adair County would be run by those already here. "This is their county," she said. "if I don't like it, I can move back to Vermont." But that isn't likely, because she doesn't want to face 16 foot snowdrifts back in Vermont.

Court votes to request Adair County Veterans Memorial Bypass as new name for road

The court voted unanimously for a resolution recommended by Judge Ann Melton to change the name of the Columbia Western Bypass to "Adair County Veterans Memorial Parkway."

The resolution is worded to allow a veto by the Kentucky Department of Highways to either allow Adair County to be a part of the name or not.Judge Melton told the court that if the State allows the name change, the county will be responsible for the cost of new signage, expected to cost approximately $600.

The unanimous vote to approve the resolution came on a motion by Magistrate Wid Harris (2), with a second by Magistrate Sammy Baker (3).

Court approves request $10,000 for Chamber

Sue Stivers, executive director of the Columbia-Adair County Chamber of Commerce, appeared before the court to request $10,000 to help with the Chamber's ongoing and increasingly higher maintenance costs.Judge Melton recommended the action, telling the court that the money was already in the budget, and the court voted 6-0, on a motion by Magistrate Sammy Baker (3), seconded by Magistrate Billy Dean Coffey (5), to grant the request. In moving for the action, Magistrate Baker called Sue Stivers one of hardest working people in the county, and complimented the work of the chamber.

Court approves City-County Parks ordinance

Another step was taken toward merging yet another City-County function. The court voted 6-0 to approve a first reading of an ordinance establishing a Columbia-Adair County Parks and Recreation Board. The vote came on a motion by Magistrate Billy Dean Coffey (5), seconded by Magistrate Perry Reeder (4).

Charles Grimsley, Columbia City Councillor and Chairman of the Board of the present Columbia Parks and Recreation Board, was present for the vote.

Grimsley has shepherded the idea and worked with both the Columbia City Council and Fiscal Court to achieve the joint operation, which is expected to start late in 2010 or very early in 2011.

More expenses on county's 20 year old jail

The court voted to approve the installation of bullet proof glass in visitation room at the Adair County Regional Jail at a cost of $1,775. The work will be done by Green River Glass of Campbellsville, KY. It had been ordered by the State Jail Inspector, Regional Jailer Wm. "Bug" Knight said.

The court also approved a $5,000 line item transfer for maintenance to provide for the expense, as budgeted maintenance funds had been 98.5% spent.

The court approved an $1,825 payment for a new electric eye for the elevator. This work had not been ordered by the inspector, but was necessary to prevent possible liabilities, Jailer Knight said.

The court unanimously approved a second reading ot the Jail's Policy and Procedures manual, the biggest change being that the Jailer will now hire and fire without court approval, as is provided in state statutes.

In his unanimously approved Jail report, Jailer Knight report gross billings for the month of $65,601 for September 1-30, 2010.

The court also unanimously approved a budget for the jail, 6-0, on a motion by Magistrate Danny Goodin (2), seconded by Magistrate Joe Rogers (6).The jailer was instructed by Judge Melton to avoid the use of hazardous duty pay individuals in non-hazardous jobs without a breakdown of the time spent. Besides the dramatically increased costs, the State Retirement system will penalize both the county and the employee should this happen, she said.The jailer said that he was not receiving reports which he could analyze to prevent the going over budget. He said that he had requested material from Adair County Finance Officer Gale Cowan, but had not received it.

Cowan, reached at 7amCT, Wednesday morning, said that the copies requested by the jailer were printed immediately after he requested it. "They laid in my office for two weeks and were never picked up."Judge Melton told the Jailer that he would be given any available materials within 30 seconds of request if he would just come by her office and request it; and if that weren't the case, he should make her aware of the fact that he had not received it.

County Treasurer's Report approved

Judge Ann Melton gave the County Treasurer's report, in the absence of Treasurer Barry Corbin. The total in all funds was $886,603.13. Judge Melton noted that a check for $138,000 on road work completed and paid had not been received.

County coffers are expected to increase in next few weeks with incoming 2010 property taxes.

New Green River Animal Shelter Director hired

The court voted unanimously to hire Sandra Ford as the new director of the Green River Animal Shelter, following the resignation of Jeff Thomas.

Ford will be paid $9.50 an hour during a six-month probationary period, after which her pay will be increased to $10.00 per hour.

The action was recommended by the five member board of directors, which includes Judge Melton, Metcalfe County Judge Greg Wilson, Russell County Judge Mickey Garner, Adair County veterinarian Dr. Jacob Feese, and Debbie Ray, representing animal rights group GRAWL.

Ford's old position of assistant director, will be advertised in Adair, Metcalfe, and Russell Counties.

Court votes to pay election workers

The court voted 6-0 to authorize payment to election workers for the Tuesday, November 2, 2010 general election. The action was taken on a motion by Magistrate Danny Goodin (1), seconded by Magistrate Joe Rogers (6).

Judge Melton said that the election workers like to start picking up checks on Wednesday morning.

Fire Departments get annual stipends

The court voted unanimously to give $2,500 to the Breeding Area Fire Department and the same amount to the Knifley Area Fire Department. The money will come from the County's General Fund and will be used by the community fire departments to help pay insurance cost.

Votes to replace missing check

The court unanimously voted to replace an election check reported lost, payment was stopped, and the check had been later found by election worker Vickie Hill. The amount of the check was $100.

Routine matters

The court voted unanimously and routinely to approve minutes for September 14, September 29, and October 8, 2010, meetings, the road report, and the Sheriff's report. A vote on paying Bills and Additions was also unanimously approved.

Sheriff Ralph Curry told the court that preparation of the 2010 property tax bills is underway, and that he expects them to be mailed in the last days of October or by the first day of November, 2010.

Court welcomes back A.L. Sinclair

The court warmly welcomed the return of Solid Waste Coordinator A.L. Sinclair, who was recovering from orthopaedic surgery.

Sinclair announced the county's 2010 Fall PRIDE cleanup, which will include free tipping at the county transfer station, 877 L. Willis RD, Columbia, KY, on Thursday and Friday, October 21 and 22, 2010, and the Annual Countywide Cleanup on Saturday, October 23, 2010.

Reading of roads

County 911 Coordinator Justin Bailey presented the reading of the roads, which included the following, all unanimously approved second readings:
  • Jimmie Jessee RD off Bird RD, in District 4, a private passage on the farm owned by Mary Phelps and JJ Hathaway
  • Keltnertown RD, District 5, 35 mph speed limit imposed
  • Colonial DR off Campbellsville RD in District 6, naming of private passageway
  • Village DR, off Campbellsville RD in District 6, naming of private passageway
Resolution may help with early warning sirens

The court approved Hazard Mitigation letters of intent for needed as pre-application to the Kentucky Emergency Management for grants for emergency sirens.

County Emergency Management Director Greg Thomas told the court that the letters were needed to apply for an additional six sirens, justified by the May 2, 2010 flooding. He said that a request for the money for eight sirens is still pending, but that there is an overlapping, new opportunity to apply for six more.

The meeting was well attended, with all members of the court except Terry Hadley (7) present. Judge Ann Melton presided. County Attorney Jennifer Hutchison Corbin, County Sheriff Ralph Curry, Regional Jailer Wm. "Bug" Knight, Adair County Solid Waste Coordinator A.L. Sinclair, County Emergency Management Coordinator Greg Thomas, and County 911 Coordinator were all present. As were City Councillors Charles Grimsley and Linda Waggener, Adair County Hospital Board of Trustees Member John Nall, members of the Columbia media, Columbia-Adair County Chamber of Commerce Executive Director Sue Stivers, Adair County Health Department Educator Jelaine Harlow and husband, Mary Phelps and JJ Hathway, and a large number of other citizens in the gallery.

The Adair County Fiscal Court gave Sue Stivers and Jelaine Harlow all they asked - Sue Stivers, left asked court for $10,000 for the Columbia-Adair County Chamber of Commerce operations, and Jelaine Harlow, Education with the Adair County Public Health Department, asked that all county-owned buildings be smoke free. Both requests were approved, Stivers' with a unanimous 6-0 vote; Harlow's, on a 5-1 vote. Magistrates Danny Goodin (1), Wid Harris (2), Sammy Baker (3), Billy Dean Coffey (5) and Joe Rogers (6) voted for the ban; Magistrate Perry Reeder (4) voted against it.

Continuing fight for county zoning

Mary Phelps and JJ Hathway residents of Bird RD in District 4 of Adair Co., KY, were disappointed that the Adair Fiscal Court is not moving faster to protect land values with zoning laws, but say they will not give up the fight. The couple's asking for more control over trailer park construction, for one thing.
