A quick decision on Jamestown Wet-Dry vote expected

State Court of Appeals usually acts quickly on election matters

A decision by the Kentucky Court of Appeals in the Jamestown Wet-Dry Vote can can be expected as early as one week from today, a clerk in the office of Russell County Circuit Court Clerk Tony Kerr said this afternoon, Monday, March 15, 2010.



Robert L. Bertram of the law firm of Bertram & Bertram has filed a motion to appeal to the Kentucky Court of Appeals the decision of special Circuit Court Judge Julia Adams which declared the wet-dry election held November 24, 2009 null and void.

The appeal was filed Thursday, March 11, 2010, on behalf of Greg Shaw, 595 Woolen Mill RD, Jamestown, KY, one day after Special Judge Julia Adams' ruling was filed in Russell County Circuit Court.

The spokesperson said that questions on election outcomes are usually decided very quickly, much more so than in civil cases, which can drag out for much longer periods.

Judge Adams had found that the wording of the queston on the ballot included "illegal language which was not mandated by statute, specifically that the words 'To promote economic development and tourism' could not be placed within the question posed to the voters in the November 24, 2009 Local Option Election."

The appeal further states:"The language of the questions posed to the voters of the three territories on November 24, 2009, was identical. However, the court, in its final judgment, failed to apply the same ruling of voiding the Jamestown and Lake Precincts elections to the City of Jamestown ruling."Attorney A.C. Donahue of Somerset is representing the dry forces in the controversy.
