Adair County Fiscal Court meeting Feb. 10, 2009 In last night's meeting
By Ed Waggener The Adair County Fiscal Court turned down, on a vote of 4-2, Magistrate Wid Harris' proposal to give $6,000 toward the expenses of the Adair County Marching Band's trip to the 2009 Macy's Thanksgiving Day parade. Harris made the proposal after Adair County Judge Executive Ann Melton had recommended the action and for the first time in her tenure, moved that the court give $6,000 to the band, with $3,000 coming out of the FY 2008-09 budget, and $3,000 coming from the 2009-2010 budget, after. Her motion received a second by Magistrate Wid Harris (2). First District Magistrate Danny Goodin's vote was "No," followed by Second District Magistrate Harris' "Yes," then Third District Magistrate Perry Reeder's "No," Sixth District Magistrate Joe Rogers "Yes," leaving Seventh District Magistrate to cast the vote which could have tied the action. After a long pause, Hadley voted "No." Had he voted yes, and there had been a tie, Adair County Judge Ann Melton could have broken the tie to give the measure a 4-3 majority. Magistrate Billy Dean Coffey (5), who is recovering from surgery, was not present at the meeting. However, immediately following the vote, Magistrate Sammy Baker told the band supporters in the audience that the matter was not over, that the court would likely revisit the issue. Magistrate Terry Hadley said he personally wanted to support the band, but he was finding a majority of his constituents against giving county funds to the band. He said that he would talk to his constituents and might vote for some county support in the future. The vote was a huge disappointment to 15 band supporters, some of whom wept while some others were sat silently stunned at the turn-down. However, Magistrate Baker and Magistrate Hadley promised to revisit the request later. And happy warriors Tim Allen, the Adair County Marching Band's director, and Superintendent Darrell Treece kept a positive outlook, even though only $35,000 of the $140,000 goal has been pledged to date. "We'll raise the money,Mr. Treece said gallantly, after the meeting. "Somehow." Mr. Allen said he expects some help from famous Kentuckians. One celebrity Kentuckian has already given. "Winona Judd sent $1,000," Director Allen said. "It's on our website." (Adairband.com) Magistrate Wid Harris was optimistic that the court would come through, later. "Maybe this thing isn't dead yet," he said. In the audience in support of the band were Superintendent Darrell Treece, Band Director TIm Allen, and Band Booster President Doyle Lloyd were Justin Burris, Erin Burris, Richard Wallace, Teresa Wallace, Dwight Rich, Chris Knifley, Shamarie Claiborne, Lisa Blackaby, Dustin Claiborne, Beth VanArsdale, and Jeff Collins. Court votes to extend Mack truck leases The court voted to extend its current lease on two Mack dump trucks for 24 month on a motion by Wid Harris (2), seconded by Joe Rogers (6), after Judge Ann Melton explained options open to the court. The trucks had been leased with a guarantee of 91% of purchase price if returned to an auction which would be held in April 2009. By extending the lease six months, the county would have been guaranteed 85%. The 24 month option will mean the trucks could be sold with an 80% of purchase price guarantee. Judge Melton said the county will likely have to buy, rather than lease, dump trucks in the future. "This program is over," she said. "I think we'll have to purchase them. Order of Affiliation for SAR approved Fiscal court unanimously approved Executive Order #9, an order of affiliation with the Adair County Search and Rescue Steam, which established "responsibilities and chain of command between the Adair County Government (Local Government), Greg Thomas (Local Director), and Adair County Rescue Team (Rescue Team in the provision of Search and Rescue Team services. In the order, the SAR is designated to play the lead role in:
The SAR is specifically not authorized to respond to missions involving known hazardous material, personal property accidents, or to take part in missions for whch they are not trained. Call out authority is designated in the order which requires the SAR to respond to these agencies: Local government, the local director, the Adair County SA Coordinator, KyEM Area 12 Manager, the State SAR Coordinator, and the Kentucky Division of Emergency Management. The chain of command section of Executive Order #9 states that when the Adair County Government declares a state of emergency, the SAR falls under the direction of the County and that in the event the County chain of command is not in existestence, the recommended chain of command will be: Local government to Local Director to SAR Chief. The order also designates how the Rescue Team will be equipped, how it will maintain fiscal responsibility, and states that the SAR cannot charge for any of its services. The order is in effect until February 28, 2010. Executive Order # 9 was approved 6-0 on a motion by Danny Goodin (1), seconded by Terry Hadley (7). Treasurer's report Adair County Treasurer Barry Corbin reported reconciled balances in all county funds of $1,214,695.03. His report was approved 6-0 on a motion by Magistrate Danny Goodin (1), seconded by Terry Hadley (7). Regional Jailer William "Bug" Knight reports on ACRJ Regional Jailer William "Bug" Knight reported a total to collect for January 2009 of $76,648.00. His report was approved 6-0, on a motion by Danny Goodin (1), seconded by Wid Harris (2). The court unanimously approved, 6-0. the hiring of Danny Kelly as a part-time jail deputy at $8.00 an hour on a motion by Sammy Baker (3), seconded by Perry Reeder (4) Jailer Knight recommended a raise of $1.00 per hour for employee Dennis Selby. "He's doing a good job," he said. The raise was unanimously approved. Mr. Knight also reported that smoke detectors at the regional jail are all working, and thanked Mr. (Wid) Harris for a donation of part of the needed supplies. Sheriff's Report approved Sheriff Ralph D. Curry reported property tax receipts of $246,806.00 for January, 2009. His report was approved 6-0 on a motion by Danny Goodin (1), seconded by Wid Harris (2). Sheriff delivers check for excess fees Sheriff Curry delivered a check for $23,454.13 for the excess fees settlement for calendar year 2008. The settlement was accepted on a motion by Magistrate Terry Hadley (1), seconded by Magistrate Joe Rogers (6). The vote was 6-0.Court orders The court unanimously approved authorizing a check to the Kentucky State Treasurer of $490.12. The vote was 6-0. Clerk's settlement for 2008 approved Adair County Clerk Sheila Blair delivered a check for $176,000.00 as a settlement for 2008. The budget settlement was approved 6-0, on a motion by Magistrate Sammy Baker (3), seconded by Magistrate Perry Reeder (4). No action on new voting machines Clerk Blair presented an option on buying e-Scan voting machines, which would let voters mark paper ballots which would be optically read by the e-Scan devices.. Money for the machines has been approved by the Federal Government, Clerk Blair said. The cost of one machine each for the 16 precincts plus two back up machines and supplies to start would be $21,450.00. Clerk Blair said that she had talked to several county clerks who have them, and like their performance, but that they were not yet approved by the Federal government. "We might buy them and find that, in two years, the Federal government will require different machines," she said.Clerk Blair said that it was her understanding that the funds provided by the Federal Government would be set aside for Adair County if not used and could be used later. On a motion by Sammy Baker (3), seconded by Danny Goodin (1), the court unanimously approved tabling the matter indefinitely. Reading of Roads Adair County 911 Coordinator Mary Allender presented the reading of the roads.A first reading was given to imposing a 25 mph speed limit on Richards Hollow Road in District 4, presented by Perry Reeder. The action was approved 6-0.A second reading was given to naming a private road, Bradley Haven Lane, in Magistrate Joe Rogers District 6. The action was approved 6-0. Solid Waste Coordinator announces training program Our Adair County national hero, Mr. A.L. Sinclair, the man Governor Beshear now knows as "The man who cleaned up Adair County," thanks to newsman Larry Smith, announced that Kentucky PRIDE has given $17, 800 to the Adair County 2009 spring clean up. We need more money, from private donations, he said. And personally thanked wal-mart for donating to cleanup effort. The Solid Waste Czar sent out a call for Adair Countians of all ranks to go to solid waste training in Somerset on March 12, 2009, at the center for rural development.
