Adair Fiscal Court Meeting January 13, 2009

Judge Ann Melton said that major projects may be on hold for 2009. In what was a mini-version of her State of the County Address to be delivered at the Columbia-Adair County Chamber of Commerce meeting at the January 20, 2009, meeting at 11:45am at Cranmer Dining Center.

"Our accounts and balances are strong," she said, "but we have cuts coming next year."


She said, "We will be very cautious," adding, there won't be a lot of new projects."

The outlook is in contrast to her first year. In 2007, she said, an extremely generous Fletcher administrations let us proceed with many projects we couldn't have done on our own."

In 2008, she said, the county benefitted from cost cuts and streamlining county government. She cited major changes in the the operation of the Adair County Road Department.

"But," she said, "we've achieved almost all the benefits we could from cost cutting. We'll continue to watch, but there just aren't as many places to cut."

Judge Melton told the court she is expecting about $120,000 less from the state, overall. "That's a lot of money," she said.

She also indicated that, at least until a contract can be rebid on blacktop, there will be fewer resurfacing jobs in the county. The current contract is for $92 per ton, and is with Gaddie-Shamrock. Judge Melton said she is hoping the company might offer a lower price in order to get more county business in the first half of 2009. Otherwise, there will be a major freeze on repaving projects in the county.

County has $1,164,088.40 in its reconciled balance

County Treasurer Barry Corbin reported that the county has $1,164,088.40 in its reconciled aaccounts. His report was accepted unanimously, 7-0 on a motion by Billy Dean Coffey (5) seconded by Terry Hadley (7).Adair EMD Greg Thomas reports on Emergency Management, SAR

Adair County EMD Greg Thomas reported to the court that the Adair County Search and Rescue Team is making great progress.

He said that six chainsaws and gas tanks have been purchased for the SAR and that the team has a been able to acquire a used truck for $10,000, purchased with a loan from an anonymous donor.

Training is underway, he said.

Emergency Management is closng out a $40,000 grant from Homeland Security and he is looking for Mitigation Grants from Homeland Security. The Emergecy Management department is looking for grants for equipment needed for the basement of the 911 building, he said. Bottom has fallen out of dump truck market, affecting lease

Jim Dotson, a representative of Worldwide Equipment, had been scheduled to appear before the court. Instead, he met earlier in the day to report that a leasing program which had guaranteed a recovery of at least 91% of two Mack Trucks the county now leases, cannot be renewed at this time. "The bottom has fallen out of the used truck market," Judge Melton told the court.

The county is faced with an option of selling two trucks at a March sale, with the 91% guarantee in place, or, she said, the Worldwide would let the county wait until September 2009, when the economy may be in recovery, and receive a guarantee of an amount yet to be announced, but which Dotson thinks will be in the 82-85% range.

The county has until February to make a decision. Magistrate Joe Rogers suggested that the county might put the trucks in the March sale, take advantage of the depressed market, and buy the trucks for less than the guarantee, with Worldwide making up the difference between what Adair County pays and the 91% guarantee.

The matter was put off until February, 2009.

Judge Melton said that the trucks had saved the county a lot of money, and, she said, "We've been able to take care of projects we just otherwise could not have done."

Surprise on Water Board Appointment

Adair County Judge Ann Melton re-appointed Robert Flowers to the Adair County Water Plant Board at last night's meeting. Mr. Flowers is sitting as the representative of the now-defunct Columbia Utilities Commission.

Judge Melton had received letter of recommendation from Columbia Mayor Pat Bell, approved by the Columbia City Council, to re-appoint June Parson to the Board and to appoint James F. "Smoky" Harper to sit on the board.

"As I always do when I make appointments," Judge Melton said, "I reviewed the statutes on the matter." She said she found that the board should consist of a member from each of the entities involved, that it should have five members, and that the balance of the board be appointed by the county judge."

After counsel with the AC Water Plant Board's General Manager, Lenny Stone, and the plant's attorney, Marshall Loy, she said that the City is entitled to one member. A second member comes from the Adair County Water District, and the balance is to be named by the Judge and be approved by Fiscal Court.

"I'm re-appointing Robert Flowers at this time," she said. "he has long experience on the board, and I think he deserves to continue in the position."

Flowers was currently serving as a representative of the Columbia Utilities Commission, which was purged at the recommendation of Mayor Bell, and folded into the city administration, leaving the city with only one "entity."

The county judge said that the decision as to whether to re-appoint June Parson or replace her with James F. "Smoky" Harper would be up to the mayor and Columbia City Council.

Judge Melton appointed members to six standing committees

As part of the New Year 2009 county government housekeeping, Judge Melton named six standing committees for fiscal court. They are:
  • SOLID WASTE COMMITTEE: Chairman Billy Dean Coffey (5), and members Wid Harris (2) and Joe Rogers (6).

  • PERSONNEL COMMITTEE: Chairman Danny Goodin (1) and members Perry Reeder (4) and County Judge Ann Melton

  • NUISANCE COMMITTEE: Chairman Terry Hadley (7), and members Sammy Baker (3) and Joe Rogers (6)

  • 911 COMMITTEE: Chairman Billy Dean Coffey (5), and members Danny Goodin (1), and Terry Hadley (7)

  • BUDGET COMMITTEE: Chairman Sammy Baker (3) and members Terry Hadley (7) and CJE Ann Melton

  • JAIL + ALL FEE OFFICE COMMITTEE: Chairman Wid Harris (2), and members Billy Dean Coffey (5) and Perry Reeder (4)
Recycler of the month delayed

With Solid Waste Czar A.L. Sinclair out of town at an important symposium, Judge Melton announced that the announcement of a Recycler of the Month would be delayed until the return of Mr. Sinclair before an announcement is made.

Superintendent Darrell Treece asks Court Support for Macy's Day Trip

Adair County School Superintendent Darrell Treece appeared before the court to request $10,000 for the Adair County Marching Band's trip to appear in the Macy's 2009 Thanksgiving Day Parade.

"This is a once in a lifetime opportunity," Mr. Treece told the Court. He said that the local band is the only Kentucky band which will appear in the event, and one of only eight high school bands in the nation to be invited. High school bands make up half the bands, he said.

Already, Mr. Treece said, the Adair County Band Boosters have raised over $29,000.

The total to be needed by November of this year is from $100-to-150,000.00 he said. The Band Boosters have ongoing fundraisers underway, he said.

The funds being raised are solely for band members and a flexible number of former band members, he said, and that is the reason for the variation.

Judge Melton said she has asked GOLD, the Governor's Office for Local Development to tell the mechanism for making the payment. "I've read the regulations," she said, "and we can contribute to the schools," she said, "but I'm asking GOLD whether we have to contribute directly to the schools or if the money can go directly to the band."

At Judge Melton's suggestion, and on a motion by Terry Hadley (1), seconded by Wid Harris (2), the board voted unanimously to continue the matter to the February meeting. The magistrates were instructed to consider the matter and talk with constitutents about it.

Court approves second reading of Clerk's Budget

The court approved, on a motion by Perry Reeder (4), seconded by Danny Goodin (1) a second reading of Adair County Court Clerk Sheila Blair's proposed budget. Clerk Blair had been scheduled to appear, but had to be elsewhere, Judge Melton said. The vote to approve the second reading was unanimous.

Judge Melton gives Road Report

With no member of the Adair County Road Department present, Judge Melton gave the road report. "They've been busy," she said. "They're already out with the boom mower. The salt spreader is here, installed, and ready to go when it snows," she said.

Sheriff reports $834,417 in taxes collected

Sheriff Ralph Curry reported that his office collected $834,417 in taxes in December. His report was approved 7-0 on a motion by Perry Reeder (4) seconded by Billy Dean Coffey, (5).The first reading of the Sheriff's 2009 budget was approved unanimously on a motion by Joe Rogers (6) seconded by Terry Hadley (7).Sheriff Currys 2009 State Advancement Bond was approved unanimously, 7-0 on a motion by Wid Harris (2) seconded by Danny Goodin (1). The appproval is a routine annual event, Judge Melton said. "We do this every year."Similarly, on a motion by Terry Hadley (7), seconded by Perry Reeder (4) the court approved, 7-0, the annual order seeting the amount for Sheriff's Deputies and Assistants for 2009.Court approves purchase of Sheriff's Jail Van
The court vote 7-0, on a motion by Terry Hadley (7) seconded by Sammy Baker (3), to buy a 15 passenger, heavy duty van from Albert Burton car sales, KY 61 South near Breeding, KY, for $2,500.00. Burton had priced the van for $3,000, Sheriff Curry said, but he was able to negotiate the price to $2,500.

The van will be used to transport prisoners from the Adair Regional Jail at the corner of Greensburg and Monroe Streets to the new Adair Judicial Center on Merchant Street, a distance of one block. At present, inmates are shackled Ft. Smith, AR - style, and paraded in orange prison garb the half block to the old Adair County Courthouse for trial, and back the same way.

The new system will take that disconcerting sight away from public scrutiny and out of sight of tourists, and will allow a bit more dignity to the inmates; but, on the other hand, it won't make citizens face the realities of the American penchant for incarcerating at the world's highest rate.

Sheriff Curry said that he'd checked the van out. That it is in good shape. And that it has the cages already built in. "I'd think the cages would cost more than $2,500, he said. The van had been used by corrections in Tennessee, Sheriff Curry said.

Sheriff gets $12,000 advancement for January payroll

As is necessary and as is done each January, the court approved an advancement of funds, this year $12,000, to the Sheriff's Department for January payroll. The money is a loan. The advance was approved unanimously, on amotion by Danny Goodin (1), seconded by Wid Harris (2), as one of two court orders.

Court authorizes $7,700 stipend to Columbia-Adair County Airport

The other court order authorized Adair County Judge Ann Melton to write a check for $7,700 to the Columbia-Adair County Airport Board for support money, to be paid from the LGEA (Local Government Economic Assistance) Fund. The vote was unananimous on a motion by Billy Dean Coffey (5), seconded by Terry Hadley (7).

The money is for airport maintenance, improvement and debt service, according to the request from Airport Manager Doug Campbell. The payment for 2008-2009 would normally have been paid in October 2008, but Campbell said in his letter that he had been pre-occupied with hangar construction and had forgotten to make the request it then.

Jail Report approved

Deputy Adair County Regional Jailer Pam Yarberry gave the jail report, in the absence of ACRJ Jailer William "Bug" Knight. She reported billings, exclusive of Adair County costs, of $76,519.43, for December 2008. The report was approved unanimously, 7-0, on a motion by Terry Hadley (7), seconded by Joe Rogers (6).

On deputy jail part-time jailer, Donnie Luttrell, was hired at a rate of $8.00 per hour. The vote to hire was unanimous.

Second readings approve 35mph speed limits on two more roads

Second readings to lower speed limits to 35 mph on two roads in District 7, C. Long Road, and Norman Grant Road, were approved in a single vote, unanimously, 7-0. The lower speed, incidentally, make use of Neighborhood Electric Vehicles (NEVs) on the two roads legal.

First reading for private road nameAdair County 911 Coordinator Mary Allender also called for the second reading by Joe Rogers (6) for the First Reading of a Private Road in his district. The private passageway is named "Bradley Haven Lane." The designation is for address and emergency purposes only; it will be privately maintained.

Mrs. Allender announced that the Adair 911 Center's GPS mapping had passed inspection by the CMRS Fund (The CMRS Emergency Telephone Fund). A lot of 911's failed," Mrs. Allender said. "So we're pleased with the results." CJE Ann Melton commented that the Adair 911 Center is working well.

Part time GRAS employee hired

Shandi Motta was hired as a part-time employee at the Green River Animal Shelter, at $7.00 an hour, to replace a part-time emplooyee who resigned. Short meeting; extremely light attendance

The meeting was over in less than one hour. It was most lightly attended meeting in Judge Melton's administration, with only governmental and media in attendance. No private citizens attended the meeting, in contrast to meetings a few months ago. State Representative Bam Carney attended the meeting. And Adair County Hospital Board Trustee John Nall was there, as was Adair County School Superintendent Darrell Treece. All seven member of Fiscal Court attended. The meeting was recorded by Lisa Lee. Sheriff Ralph Curry, County Attorney Jennifer Hutchison Corbin, and Deputy Pam Yarberry for Jailer Bug Knight were representatives of the elected offices, besides Judge Melton. Also present were AC EMD Greg Thomas and AC 911 Coordinator Mary Allender.
