Adair County Fiscal Court Dec. 9, 2008 meeting report

In last night's Adair County Fiscal Court meeting
  • Recycling Center gets early Christmas present from Walmart

Adair County got a nice Christmas present, Adair County Solid Waste Coordinator A.L. Sinclair told Fiscal Court last night. A baler has been donated to the Adair County Recycling Center by Walmart.



"I kept telling Danny (Danny Bragg, manager of the Holladay Place Wal-Mart Supercenter) that he ought to give the county the store's old baler when he got a new one," Sinclair told the court.

"He told me the other day that we'd need a letter from the court taking responsibility for the baler, and it would be ours."

The letter was delivered, and county employees have moved the baler to the ACRC building off Campbellsville Road. "It's a dandy," Sinclair said. "It's set up and ready."

Judge Melton said that she hoped all would thank Mr. Bragg and Wal-Mart for their community support. "Danny Bragg and all the associates there really help when it comes to volunteering and helping the community," she said.

Sinclair reported that a big dump on Pelham Branch Road had been cleaned up in the past month.

He said that he had found out where Adair County's tire amnesty money had gone. "Some people in Frankfort saw the big pile of money for the tire amnesty program and took it," he said. The tire amnesty program for Adair County is now scheduled for 2010, "Unless they see the money and take it again," Sinclair said.

Sinclair said that when he and Adair County CJE Administrative Assistant Lisa Lee attended a Solid Waste Coordinators of Kentucky (SWaCK) conference in Covington, "Speaker after speaker would tell us what we ought to be doing," he said, "and each time, I'd say to Lisa, 'We're already doing that.'"

"We're way ahead of most other counties," Sinclair said.

Employees, but not elected officials, get 3% pay raise

Adair County employees, but not elected officials, were awarded a 3% pay raise after hearing a report by Personnel Committee Chair, Magistrate Danny Goodin (1). Employees at the Green River Animal Shelter were given slightly higher raises, based on the Personnel Committee's recommendation.

In three separate, unanimous votes, the court voted to:
  • Raise all county employees' pay by 3% effective January 1, 2008
  • Raise part time employees at the Green River Animal Shelter from $6.55 to $7.00 an hour
  • Raise a full time employee to $7.50 an hour
Goodin said that the recommendations his committee would make were based on the fact that the county finances are in good shape.

The court approves hazardous duty status for Sheriff's Deputies

The Court voted to approve hazardous duty status for Adair County Sheriff's Department deputies, and, in a separate action, voted to authorize Adair County Judge Ann Melton to sign necessary paperwork related to the matter.

County taxes are pouring in

Adair County Sheriff Ralph Curry sent a report to the Adair Fiscal Court which showed that, through December 3, 2008, almost three fourths of the property tax due had been collected.

Of around $4,000,000 to be collected, Sheriff Curry reported $2,766,064.57 had been already been paid.

A check for $435,715.85 was issued to the Adair Fiscal Court for that first period. The sheriff's report included these other payments, after refunds:
  • Adair County Schools, $1,407,471.46
  • Adair County Library, $153,783.67
  • Adair Ambulance, $135,218.80
  • Adair County Extension Service, $106,614.88
  • Adair County Health District, $86,242.80
  • Adair County Soil Conservation, $48,426.81
  • Fire, $1,476.41
The Sheriff's report was accepted unanimously on 7-0.

County had $784,854.29 in all funds before 2008 taxes arrive

The county treasurer, Barry Corbin, reported a cash balance for all funds of through November 30, 2008, of $784,854.29. This figure was before the check for $435,715.85 for 2008 property taxes were received. The treasurer's report was approved unanimously, 7-0, on a motion by Magistrate Billy Dean Coffey (5), seconded by Terry Hadley (7).

Two budget transfers, one amendment, approved were made

The court voted unanimously to allow the county treasurer to transfer up to $75,000 to the Jail Fund, and to make all transfers necessary to end the quarter. Budget amendments were also approved.

County Clerk's office will return lower excess fees

One area of County government has somewhat less rosy outlook. County Court Sheila Blair received approval for her deparment's 2009 budget, which projects a return of excess fees for 2009 of $158,383.86. The office returned $201,000 in 2007, and the estimate for the current year is $150,000.

The county court clerk's budget for 2009, which includes a 3% pay raise, was approved unanimously, 7-0.

Road supervisor Jobe Darnell issues report

County Road Supervisor Jobe Darnell reported the following accomplishments for the month of November:
  • Footers constructed on bridge at Sulphur Creek
  • 19 road signs installed
  • Salt spreaders and plows on trucks made ready for winter
  • All Adair County Road Department equipment serviced and winterized
  • Boommower work finished in District 5 (Billy Dean Coffey), and moved to District 6 (Joe Rogers)
Mr. Darnell also said that a new IMPCO salt spreader, plow, costing approximately $9,400, were being installed in Madisonville, KY.

His report was approved 7-0.

Road supervisor reappointed

Judge Ann Melton recommended that Mr. Darnell, who was appointed to a two year term in two years ago, be re-appointed to a term which will extend his time in office to December 10, 2010.

The vote, on a motion by Perry Reeder (4), seconded by Terry Hadley (7), was 7-0 to affirm the appointment.

"Jobe has done a good job," Judge Melton said.

Surplus Road Department truck brings $537.27

Two bids were received for a surplus Adair County Road Department Truck. Magistrates voted 6-0 to sell the truck to the high bidder, Magistrate Terry Hadley, who abstained.The sealed bids were:
  • Magistrate Terry Hadley (7), $537.27
  • Adair County Road Department employee Billy Cowan, $200.00
Higher bid accepted for County Payroll preparation

Bids for preparation of the county's biweekly payroll were opened. Two bids were received, with an annual cost difference of $150.
  • June Parson bid $3,150, or $262.50 per month
  • Lisa Loy, CPA, bid $3,300, or $275.00 per month
After both full proposals were passed around for all magistrates to review them, the Court voted 7-0, on a motion by Joe Rogers (6), seconded by Sammy Baker (3) to award the contract for the coming year to Lisa Loy.

Lisa Loy currently prepares the payroll. Magistrate Sammy Baker asked Judge Melton if she was satisfied with the work done by Loy, and Judge Melton affirmed with a nod. Judge Melton said that were would be additional in-house work to transfer the work to a new preparer.

Two members of the Adair County Extension board re-appointed

Two members of the Adair County Extension Board were re-appointed on the recommendation of CJE Ann Melton.
  • Danny Wilkinson was re-appointed to a new 3-year term on a motion by Magistrate Terry Hadley (7), seconded by Magistrate Sammy Baker (3). The vote was 7-0
  • Kirby Hancock was approved for another 3 year term on a motion by Magistrate Baker, seconded by Magistrate Wid Harris (2). The vote again was unanimous
Court approves signing of papers related to SB 66

The court voted 7-0, on a motion by Magistrate Billy D. Coffey (5), seconded by Magistrate Joe Rogers (6) to authorize Judge Melton to sign paperwork related to grant applications for the Adair County Emergency Medical Services.

The state has a total of $1,200,000--an average of $10,000 per county--to award to county ambulance services. The grant applications have to be received in Frankfort by March 31, 2008.

The Adair County Ambulance is applying for a grant toward the purchase of a new (450 miles on odometer) $95,889.00 2009 ambulance from McCoy-Miller to replace an ambulance with 133,033 miles.

Jail reports billings of $77,711.08 for November

Adair County Regional Jailer Wm. "Bug" Knight reported net billings of $77,711.08 for November, after $24,351.18 for housing Adair County inmates was deducted. The Jail Report for November 2008 reported these income areas, with prisoner days in parentheses, totaling $92,782.46:
  • Class D Inmates (933) $29,240.22
  • Adair County (777) $24,351.18
  • Class C Inmates (379) $11,877.86
  • Cumberland County (448) $11,560.00
  • Russell County (268) $6,978.00
  • Controlled intake (209) $6,550.06
  • Alternative Sentenced (41) $1,284.94
  • Parole violator (3) $940.20.
    TOTAL $92,782.46

Additional billings by the ACRJ for November included in Jailer Knight's report are as follows:
  • Total booking fees, $1,144.47
  • Total medical, $137.38
  • Other income, $4,288.32
  • Total per diem, $3,023.45
  • Cumberland medical, $505.43
  • Russell medical, $180.75
The jail report was accepted on a motion by Perry Reeder (4), seconded by Danny Goodin (1). The vote was 7-0.
Reading of Roads

Adair County 911 Coordinator Mary Allender presided over the reading of roads. Actions included:
  • Second readings for a stop sign on Pear Tree Lane in District 3, a 35 mph speed limit for Brock Burris Road in District 4, and a name correction to Odell Baker Road, the name it has been traditionally known as, instead of Baker Road as listed on official maps, in District 6. All three second readings were unananimously approved.
  • A first reading for 35 mph speed limits on two roads, Norman Grant Road and C. Long Road, in District 7. The first readings were unanimously approved, 7-0.
Allender reported that sound baffles have been installed between dispatcher areas on the second floor of the Adair 911 Center, and that dispatchers are reporting that the baffles have greatly reduced sound interference.

County takes over Lasley Road Bridge

Judge Melton read a letter from the Commonwealth of Kentucky Department of Highways, requesting the County assume ownership and maintenance of a new bridge over Brush Creek and approach roadway segments on Lasley Road in the Flatwoods Community, Adair County Magisterial District 4.

On a motion by Sammy Baker (3), seconded by Perry Reeder (4), the court authorized the acceptance unanimously.

The court also authorized Judge Melton to continue the storage of county owned bushhogs in a private barn. Judge Melton said that she had gotten criticism for the county accepting the favor without reimbursing the donor.

First District Magistrate Danny Goodin said it is not uncommon for citizens to help the county and expect nothing in return. "I've had private loggers remove fallen trees and absolutely refuse to let me ask the court to re-imburse them."

Magistrate Wid Harris agreed. Mowing and cleaning of county rights of ways were also cited.

The court voted 7-0 to continue to accept the sheltering of the equipment at no cost to the county, "if the offer is still good." Judge Melton said that the county's insurance had been checked, and that the equipment is covered.

Announces state will pay for 80% of Gradyville Country Club Rd. bridge

Judge Melton re-iterated an earlier announcement that the Commissioner of Rural Highways had assured her that the state will pay for 80% of the cost of a replacement bridge on Gradyville Country Club Road. "We haven't received the official letter yet," she said, "but I'm sure the Commissioner will follow through."

Judge Melton passes out committee assignment options

Judge Melton passed out a list of committee assignments and asked the magistrates to look them over and pick out the standing committees they would like to serve on. "I hope each of you will find at least two committees you're willing be a part of," she said. The committees will be appointed at the January 2009 meeting, she said.

The report showed November Expenses of $2,477.21, plus utilities, salaries, and vehicle.

Routine matters approved unanimously

Routine matters including payment of bills and approval of the November 17, 2008 minutes, were approved unananimously.

No citizen's comment, no magistrate announcements

There were no citizen comments, no announcements by members of Fiscal Court. A schedule appearance by Jim Dotson of Worldwide Equipment was rescheduled by Dotson for the January 2009 meeting.

Attendance off in recent meetings

For whatever reason, attendance at recent meetings of Adair Fiscal Court has been suppressed. Last night's meeting followed the trend. After almost two full years' of increasing participation, the last two meetings have reversed the trend, and the dream of New England style assemblies, with enthusiastic public attendance and involvement is no longer evident.

The meeting was over, except for an Executive Session related to possible litigation, in about one hour.
All court members were present, as were CJE Ann Melton, CJE AA Lisa Lee, recording the proceedings; County Attorney Jennifer Hutchison-Corbin, Jailer Bug Knight, County Treasurer A.L. Sinclair, County Road Supervisor Jobe Darnell, County 911 and several members of his department, Coordinator Mary Allender, Adair Hospital Board trustee John Nall, and members of the media.
