Judge Loy orders continuance in criminal littering case Coordinator Sinclair will inspect compliance, receipt for disposal of trash dumped along Sulphur Creek on Thanksgiving eve, and will drop charges after verification By Ed Waggener Following a conference between County Attorney Jennifer Hutchison-Corbin, Adair County Solid Waste Coordinator A.L. Sinclair, and Carolyn Harden, the defendant facing arraignment in a criminal littering case, Judge Michael Loy continued the arraignment until Monday, December 17, 2007. The continuance was made in Adair Circuit Court on Wednesday, December 5, 2007, in Adair District Court. Hutchison-Corbin and Sinclair plan to ask for dismissal of the charges pending Sinclair's inspection of the site and confirmation that the defendant has a receipt to show proper disposal of the trash. "If everything checks out," Sinclair said, "we'll drop the charges." A warrant had been issued for Carolyn Harden after evidence, including prescription bottles, were found in trash dumped at Sulphur Creek on Hancock Road in District 7. The trash was discovered on Wednesday, November 21, 2007, Thanksgiving eve. Sinclair and his crew removed the bags of garbage from the creek bank, inspected them for the evidence, and obtained the warrant. The bags were left for the defendant to pick up and take to the landfill. Sinclair said that the defendant told him that had been done. He trusts that has been done, he said, but will follow the Reagan Rule and verify. "That will be it," he said. "if she's cleaned up the mess and has a receipt to show for it," he said, "we're satisfied. I don't think she will do it again." This story was posted on 2007-12-06 05:35:31
