Trial of Trooper Burton gets underway this morning in Liberty ColumbiaMagazine.com story The trial of Kentucky State Police Trooper Bramlett J. Burton will get underway in Liberty, KY, this morning at 9:00amET/8:00amCT, with Adair/Casey Circuit Judge James G. Weddle presiding. Trooper Burton is charged with reckless homicide in the death of Billy J. Phillips, Columbia painting contractor, following an incident at Adair County Regional Jail on Friday, June 1, 2007. The trial will take place in the new Casey County Justice Center, located on the southwest corner of the square in Liberty, at 231 Courthouse Square. Via the Louie B. Nunn Parkway to Russell Springs, then north of US 127 to KY 70 at Liberty, KY, the new trial site is 38 miles away from the Adair County Circuit Court Room at 500 Public Square in Columbia. . Mr. Phillips died Monday, June 4, 2007, at the University of Kentucky Medical Center, of injuries sustained while in custody. A change of venue, requested by Trooper Burton's defense attorney, Steve Schroering of Louisville, KY, was granted on November 6, 2007, in Adair Circuit Court. In making the decision, Judge Weddle said at that time that because of the publicity involved in the case there might be the chance of one tainted juror being seated. Judge Weddle said on November 6, 2007, that Casey County has a pool of 70 jurors from which to select the 12-member panel, and the facilities needed to handle the case. Because the case has drawn so much less publicity there than in Columbia, it was Judge Weddle's stated belief that the possibility of a tainted juror being seated there would be much less. Today's trial will start with the selection of jurors. Commonwealth Attorney Eddie Montgomery, Somerset, KY, had opposed the change of venue to Liberty, KY, acting on the family's hope that the trial could be held in Columbia, KY.
