Judge Weddle finds Wellie Paul Grant incompetent to stand trial

After a hearing which lasted several hours, Adair Circuit Judge James G. Weddle ruled last evening in Adair Circuit Court that Wellie Paul Grant is incompetent to stand trial at this time.

Judge Weddle also found that Grant is a threat to himself and others.

At Judge Weddle's order, Grant is being transported "as soon as possible" to Eastern State Hospital in Lexington, KY, where he is ordered to be kept a minimum of 360 days.



Grant was charged in the June 10, 2006 Beech Grove Separate Baptist Church picnic grounds shooting of popular Columbia businessman Rex Coffey, who died June 11, 2006, at Vanderbilt Hospital in Nashville, TN.

In his ruliing, Judge Weddle made the following findings of fact and conclusion of law:
  1. "The Defendant, Wellie Paul Grant, is incompetent to stand trial in that he lacks the capacity to appreciate the nature and consequences of the proceedings against him should this case continue to trial and that he would be unable to participate rationally or to assist his counsel in his defense.
  2. "There is no reasonable likelihood that the Defendant will gain competency in the foreseeable future
  3. "The Defendant is an immediate threat to both himself and others, and the Defendant is in need of immediate and long-term institutionalization."
Judge Weddle issued the following orders:
  1. "The charges against the Defendant are continued generally.
  2. "Pursuant tot he provisions of KRS 202A and/or KRS 202B, the Defendant shall be committed to Eastern State Hospital, Lexington, Fayette County, Kentucky, for a period of three hundred, sixty (360) days. At the completion of the three hundred, sixity (360) day period, another hearing shall be held to determine the Defenant's mental ability and his competency to stand trial.
  3. "Immediately upon his admission to Eastern State Hospital, the Defendant shall undergo an evaluation regarding his competency to stand trial, and a report shall be generated and delivered to the Court as soon as possible. A copy of a previous competency evaluation, which was prepared by Dr. Stephen Free, is attached hereto."
  4. "The Adair County Sheriff shall transport the Defendant, Wellie Paul Grant, to Eastern State Hospital, Lexington, Fayette County, Kentucky, as soon as possible, where he shall remain for a period of three hundred, sixty (36) days, unless otherwise ordered by this court."
      The ordered was signed "James G. Weddle, Judge," and entered November 28, 2007, into the Adair Circuit Court records.

      Attorneys in the case were Commonwealth's Attorney Brian Wright of Liberty and, for the defense, Robert Bertram of Jamestown, KY.
