Ruling on change of venue will have to wait Phillips' family objects to moving trial from Columbia; Judge Weddle sets election day hearing With one photo, link By Ed Waggener A ruling on attorney Steve Schroering's petition to have the reckless homicide trial of Kentucky State Police Trooper Bramlett (BJ) Burton from Columbia will have to wait until a evidentiary hearing at 9:00amCT, Tuesday, November 6, 2007, which is also election day, as Judge Weddle reminded the attorneys before setting the special hearing. Trooper Burton has been charged with reckless homicide in the death of Billy Phillips on July 4, 2007, following injuries sustained at Adair County Regional Jail a few days earlier. Adair Circuit Judge James G. Weddle made the ruling yesterday after Prosecutor Eddie Montgomery held a conference with the wife and family of Billy Phillips, who objected to having the trial moved. Judge Weddle told Montgomery to file at least two affidavits to support his objections. Yesterday's hearing was well attended, both by supporters of the Phillips family and by the news media, all local media present, augmented by the presence of Bill Estep, Somerset bureau chief for the Lexington Herald and a news crew from WLEX-Tv 18, Lexington, KY.
