Attention 16- and 17-year old driving age students and parents

The "No Pass/No Drive" law has been re-enacted

The 2007 legislative session re-enacted the "No Pass/No Drive" Law (HB 32/KRS 159.051). Statewide implementation of this statute begins August 1, 2007 and involves sixteen and seventeen year old students in every public and private school district across Kentucky, including students being schooled at home. Pursuant to 601 KAR 13:070 before a sixteen or seventeen year old goes to the circuit clerk's office to obtain an instructional permit or license, a School Enrollment Verification form must be filled out by school personnel verifying the student is in compliance with the "No Pass/No Drive" Law. If the student is not complaint, a form will not be issued and the student will not be allowed to apply for a driving permit or license. School Enrollment Verification forms are available in the Adair County High and Adair Alternative School offices.



The completed School Verification form must be presented at the circuit clerk's office along with a social security card, birth certificate and any other required identification before a student is eligible to obtain a driver instruction permit or license. Additionally, a parent or legal guardian must be present at the circuit clerk's office to give his/her consent for application for driving privileges by filling out the driver license/ID card application (TC 94-30 form). This form has been revised to include parental consent for the receipt and release of student information regarding the attendance and academic requirements for a minor to acquire and keep an operator's license, intermediate license, instructional permit, or privilege to operate a motor vehicle.

The "No Pass/No Drive" Statute not only may result in students being denied initial application for a driver's permit, but the law also requires revocation of driver's licenses or permits of sixteen (16) and seventeen (17) year old students who become academically deficient or deficient in school attendance. When a sixteen or seventeen year old student is not compliant with the "No Pass/No Drive" Law, school personnel are required by this statute to report his/her name to the Transportation Cabinet, Division of Driver Licensing in Frankfort, who will then revoke his/her driving permit or license until the district reports that the student is once again in compliance.

No pass/No drive" academic and attendances deficiencies guidelines

Academic and attendance deficiencies for students age sixteen (16) or seventeen (17) enrolled in regular, alternative, part-time, and special education programs shall be defined as follows:
  1. Students shall be deemed academically deficient if they have not received passing grades in at least three (3) of the four (4) courses taken in the preceding semester. *(Adair County High students must pass three (3) of the four (4) courses taken each semester to maintain drivers licenses/permits or be eligible to apply for a driving permit).
  2. Students shall be deemed deficient in attendance when they drop out of school or accumulate nine (9) unexcused absences during a semester. Suspensions shall be considered unexcused absences.
  3. Reports of noncompliance based on academic deficiency (grades), dropouts and attendance will be made beginning with grades from the fall 2007 semester. Students are considered noncompliant until they become compliant or reach age 18. For school purposes, students are usually noncompliant a full semester until they have time (the following semester) to improve their grades and/or attendance.
Reinstatement of driving privileges

Reinstatement of a student's driver's permit or license does not occur until the student becomes compliant with the "No Pass/No Drive" Law, this is usually a whole semester or following completion of summer school. After a student becomes compliant, the school will make the required report to the Transportation Cabinet, Division of Driver Licensing requesting reinstatement of a student's license or permit. The sole purpose of this law is to promote good student attendance, academic success and dropout prevention by providing an incentive for students to stay in school and pass their courses.

Student's academic success is directly linked to school attendance. All students are expected and required by law to be in school every day on time or out for other valid reasons.
