Proposed City Ordinance No 540.9: New parking regulations

First reading was given last night, Monday, April 2, 2007. at the regular meeting of the Columbia City Council to Mayor Pat Bell's proposed ordinance revising parking regulations in the City of Columbia. The proposed changes are printed below in their entirety, with strike-throughs for old parts of the ordinance.

AN ORDINANCE AMENDING ORDINANCE NO. 540.8
ESTABLISHING REGULATIONS FOR PARKING INTHE CITY OF COLUMBIA


THE CITY COUNCIL OF THE CITY OF COLUMBIA, KENTUCKY, DOES ORDAIN AS FOLLOWS:1. The Ordinances regulating parking and establishing penalties for the violations thereof in the City of Columbia prior to the date of this Ordinance are hereby repealed.

2. In accordance with the officials signs and markings now in existence in the City of Columbia, parking meter zones and restricted parking zones are hereby established; parking meters shall be coin operated for the full period of time as expressed on the meter and said zones shall be enforced except during the hours of 5:00 P.M. until 8:00 A.M. of the following day, Sundays, and public holidays or special designated days authorized by the city legislative body.No person shall deposit or attempt to deposit in any parking meter any slug, button or any other device or substitute for coins of the United States currency. No person shall deface, tamper with, destroy or impair the usefulness of any parking meter.

3. Certain areas in the downtown area shall be designated for two (2) hour free parking between the times of 8:00 A.M. and 5:00 P.M. for all days except Sundays, public holidays or special designated days authorized by the city legislative body. Said area shall include the Public Square and one (1) block off said square as designated by public notices.

4. The following penalties for parking violations shall be in effect for the City of Columbia:

A. Meter Violations$5.00
B. Double Parking$5.00$20.00
C. Parking On Yellow Line$10.00 $20.00
D. Parking In Restricted Zone$10.00 $20.00
E. Parking At Fire Plug$10.00 $20.00
F. Parking On Sidewalk$10.00 $20.00
G. Blocking Driveways$10.00 $20.00
H. Parking on Left Side Of Two-Way Street$10.00 $20.00
I. Parking in Rented Spaces In City Parking Ares$10.00 $20.00
J. Parking in Excess of Two (2) Hour Limit$10.00 $20.00
K. Handicap Parking Violation$20.00 $50.00
5. It if further provided that should the penalty provided herein not be paid within seventy-two (72) hours seven (7) days, all $5.00 violations shall be increased to $10.00, all $10.00 violations shall be increased to $20.00 and all $20.00 violations shall be increased to $40.00 and all $50.00 violations shall be increased to $100.00. It is also provided that should these violations not be paid within seventy-two (72) hours seven (7) days, the Chief of Police shall cause warrants, or summons, to be issued in Adair District Court for the enforcement of this ordinance.

6. For the violations of Section 2 of this ordinance, a person shall be fined not less than $10.00 $20.00 or more than $100.00 for each violation in the discretion of the Court.

7. This ordinance shall be and become in full force and effect immediately upon its adoption and publication as required by law, and all ordinances, resolutions and orders, or parts thereof, in conflict herewith are to the extent of said conflict hereby repealed..
