P&Z approves zoning change for new florist

P&Z board action moves Radius Brown's Crossroads Florist and Gift Shop nearer to reality. Roy Rademacher speaks change, opposing it as spot zoning, but P&Z unanimously approves change

There were opposing sides in Radius Brown's request for a zoning change at 215 Westwood Drive at the P&Z hearing last night, but Brown won approval from the panel in a sessions which lasted only 10 minutes.

The P&Z approved the request and authorized Chairman Joe Flowers to send a letter to the Columbia City Council recommending that 215 Westwood Drive be changed from R-1 Low Density Residential to C-2 Highway Commercial.



The action came at a special called meeting, Wednesday, March 28, 2007, at 6:00pm CT. All members were present. The vote to approve the change was 5-0, with members Annissa Radford and George Kolbenschlag and Chairman Joe Flowers affirming a motion by Lloyd French, seconded by Sue Stivers, to approve the recommendation.

A motion by member Sue Stivers, seconded by member Annissa Radford, passed 5-0 to authorize the letter to the Council.

Brown's letter said that he intends to open a florist and gift shop in an existing building at the site. The letter said that there would be little traffic and no noise.

The site change was opposed by Roy Rademacher, who said he saw it as spot zoning, to which he is opposed. Mr. Rademacher was one of the Historic Greensburg Street District neighbors who successfully opposed a zoning change for a dry cleaners at 505 Greensburg Street last year.

The lot at 215 Westwood does adjoin some residential areas, but Mr. Brown said in his remarks that the site also adjoins Bob Barnes storage business as well as commercial property owned by Travis Coomer and Ben Arnold. "I've heard that Mr. Arnold intends to develop his land," Brown said. Brown's site is at the intersection of Westwood and what will be the Western Bypass of Columbia.

He noted that a nearby subdivision had not been developed because of the lack of sewer services.

Member George Kolbenschlag said that he supports Mr. Rademacher in his opposition to spot zoning, "But," he said, "I don't think this fits the classic definition of spot zoning. There are commercial properties around it."

Member Annissa Radford, said that she remains in opposition to spot zoning, but agreed with Kolbenschlag that Brown's proposal would fit the description.

Brown's daughters, Ann Giles and Jennifer Yarberry, spoke in support of their father, and cited memories of commercial development in the neighborhood since their childhood there.

Brown said that the business he will open will likely be named Crossroads Flowers & Gift Shop. It will be housed in remodeled, existing 22x32 (704 sq. ft.) building.

Sue Stivers acted as secretary for the meeting.

In a three minute meeting following a seven-minute contested hearing, the P&Z unanimously approved Brown's request for the zoning change, along with a letter to be sent to the Columbia City Council, which next meets Monday, April 2, 2007.
