Adair Fiscal Court meeting, March 6, 2007 report


  • ROADS: Court buys new $140,200 John Deere motor grader. Finances with KACO. State road aid contract approved. New speed limit on Oxford Place gets final approval needed. Several roads get first reading. Crumbling chip and seal jobs scrutinized. Jobe Darnell, Road Department lauded for winter work
  • PERSONNEL & PEOPLE: Three deputy jail employees approved. Two 911 dispatchers hired. Ambulance Board member appointed. Judge Melton names 911 building committee. 911 Dispatchers added to Personnel Policies Manual.

In last night's Adair County Fiscal Court, the court worked through several major items quickly, with the longest deliberation coming on the decision to buy a new motor grader for the Adair County Road Department.



It was a wonderful "my Dad's Chevrolet is better than your dad's Ford, my Raleigh is better than your Western Flyer," type debate, which in the end, was won out by the green of John Deere. However, our new grader will be highway department yellow, not the green of your John Deere riding mower:

The Adair County Fiscal Court settled on a 2007 John Deere 670 D Motor Grader from Holt Equipment Company.

The court met one week early for the March session, because of Judge Melton has an out of town appointment on March 13, 2007, the regular second Tuesday meeting date this year.

The new machine will cost $140,200 and will be delivered to the Adair County Road Department in two-four weeks. It will come with standard cabin air conditioner.

The magistrates chose the John Deere over three other options, one of which, a Volvo motor grader from Rudd Equipment was $700 under the John Deere.

The bids were as follows:
  1. Rudd Equipment Co., 2007 Volvo, $139,500
  2. Holt Equipment Co., 2007 John Deere 670D, $140,200
  3. Diamond Equipment Co., 2007 Case, $143,939
  4. Wayne Equipment Co., Caterpillar 120H, $164,409
The motion to buy the John Deere was made by Roger Stephens (1), seconded by Perry Reeder (4). The vote was 6-1, with Stephens and Reeder being joined by Wid Harris (2), Sammy Baker (3), Joe Rogers (6) and Terry Hadley (7). Magistrate Billy Dean Coffey voted no.

KACO gets financing contract

County Judge-Executive Ann Melton told the magistrates, after the purchase was approved, "Yes, we have to pay for it." The motor grader will be paid for with $80,000 from LGEA (Local Government Economic Assistance) funds.

Judge Melton said that she had reviewed the two financing proposals, one from Ross-Sinclaire & Associates and the other from the Kentucky Association of Counties Organization (KACO) and recommended the KACO plan. "We don't have to pay upfront fees with KACO," she said.

A resolution was introduced by Magistrate Sammy Baker to borrow $60,000 through KACO. "We'll come up with the $200 somewhere," Judge Melton said of the balance not paid in the downstroke and the $60,000 being borrowed.

The money is to be paid back over a three year period. The county's rate of interest is 4.52%.

On a second by Billy Dean Coffey, the proposal was unanimously approved.

Court routinely accepts County Road Aid

The county routinely approved the County Road Aid agreement with the State of Kentucky. The vote was 7-0 on a motion by Roger Stephens, seconded Wid Harris.

Road readings

First readings for inclusions were given to the following roads: Fourth District's Will Walker Lane, Music Lane, and Mountain View (cut off Grider Road) by new KY 61. See photo which follows.

A second reading on inclusion of Fernwood off Butler Branch was approved 7-0.

A first reading was given for deleting MacDonald Drive from the county system. It did not meet requirements and had been included last year in a package with other roads in the Horton subdivision in District 7. "That was done before I took office," Judge Melton said, "and since my son is the only resident on the road, I for sure want to have it removed (from county maintenance)." The road had not been chipped and sealed as required for admission to the county maintenance system.

Oxford Place speed limit gets second reading

The court unanimously approved the second reading of the county ordinance placing a 25 mph speed limit on Oxford Place road. The action came on a motion by Roger Stephens, seconded by Perry Reeder.

911 Building Committee appointed

Judge Melton announced the appointment of a building committee for the county's new 911 dispatch center. She will serve on the committee along with Mary Allender, the Adair County 911 Coordinator; Justin Claywell, chief 911 dispatcher; Fifth District Magistrate Billy Dean Coffey, and Third District Magistrate Sammy Baker.

Two 911 dispatchers hired

Robin Slater was hired at $8.25 and hour as a temporary FT 911 Dispatcher, and John Arnold was hired as a temporary PT dispatcher at $8.25 an hour. Each will go to $8.50 an hour after six months. The vote was unanimous.

First reading to add 911 Dispatchers to Personel Policy

A first reading was given to include the new 911 Dispatchers unit in the county's Personnel Policies Manual. The reading was approved 7-0.

Road work approved, but chip and seal roads questioned

The court approved the road work 7-0. But Judge Ann Melton and County Roads Department Supervisor Jobe Darnell said that a new look may need to be taken for chip and seal work. The Judge and Supervisor said that inspections of Neat Hollow Roard and Chestnut Corners showed crumbling chip and seal surfaces. Judge Melton said that Gaddie Shamrock said the surface condition was due to lack of ditching, but Judge Melton disagreed, saying that some of the roads which crumbled have adequate drainage.

Third District Magistrate Sammy Baker commended Supervisor Darnell on the County's snow removal. "I heard a lot of good things on the road work done in the bad weather," he said.

Second reading approved for new county road code

The court unanimously approved the second reading of the ordinance pertaining to qualifications and/or extensions in the Adair County Road System. The vote was 7-0, on a motion by Perry Reeder, seconded by Billy Dean Coffey.

The ordinance was one of the major county government reforms recommended by Judge Melton in the first regular meeting after she took office in January.

Ashland Lane/Washington Lane grandfathered in road system

Magistrate Joe Rogers asked for an exception to the new code for county roads, requesting that two roads off Huntington Way at Coburg, in his Sixth District, be grandfathered into the county system. "I thought they were already included, but found out later they didn't have a county number," he said.

The roads are very short, only .2 of a mile and .04 mile long, he said. On his motion, seconded by Wid Harris, the court voted 6-0 to include the roads. First District Magistrate Roger Stephens abstained. "I don't understand it," he said.

Sheriff reports $130,000 in tax collection

The court uninamously approved the Sheriff's report. Sheriff Ralph Curry said that $130,000 in property taxes were collected in February 2007.

Budget transfers approved

The court approved two budget transfers, both from the General Fund to Recycling. On February 22, $1,000 was transferred, and on February 28, $1,500 was transferred.

Jail reports $69,216.86 in February billings

Adair County Regional Jailer William "Bug" Knight reported $69,216.86 in total billings. His report was approved 7-0, as were his requests for three appointments:
  1. Steve Foster, temporary FT deputy, to replace Marshall Bunch, who resigned

  2. Kenny Coffey, FT deputy, to replace John Foster, who quit

  3. Greg Burton, PT deputy
Fencing around Restrictive Custody tabled

Judge Melton said that one proposal had been received for a fence around the Restrictive Custody facility on Campbellsville Road. She said that she would prefer to wait for another proposal before considering the matter and asked that the matter be tabled. The vote was 7-0, with Magistrate Sammy Baker moving to follow Judge Melton's advice to the court.

Court bans banners on Courthouse

The court voted to ban the hanging of banners on the Adair County Courthouse. The suggestion for the ban came from the Columbia-Adair County Chamber of Commerce, in a letter from President Darrell Overstreet, who was in attendance at the meeting, and Renaissance Columbia Chairman Benton Fudge. "Many tourists," the letter said, "make negative remarks about signs, etc., being hung on our beautiful courthouse. They cannot understand why this would be allowed as it distracts so badly from our historic building."

The ordinance suggested in the letter was unanimously approved. Magistrate Joe Rogers suggested that military banners be allowed, but Magistrate Wid Harris objected, saying it would be to much trouble to start making exceptions. On Harris motion, the ordinance was given a first reading and approved. After a second reading and publication, the ordinance will be in force. Violations carry fines from $100 to $500, and constitute a misdemeanor.

Ambulance board member appointed

Judge Melton recommended and the court approved the appointment of Sherry Hutchison, an RN at Westlake Regional Hospital, to the Adair County Ambulance Board. The vote was 7-0. The Adair County Ambulance Board oversees the operation of the Adair County EMS.

Sinclair is now taking dumpers to court

Adair County Solid Waste Coordinator A.L. "Pee Wee" Sinclair said that spring roadside cleanups are underway, with jail inmates now on the job. He told the court that he would be appearing in court March 7, 2007, with evidence found in two illegal dumps. Illegal dumpers will be cited when his detective work establishes beyond a reasonable doubt to whom the garbage belonged.

Offenders have two choices, he said: 1) They can face charges in court, or 2) They can confess, go back to the mess they made and clean it up. Sinclair said that while he favors the latter, he has no qualms about bringing the full force of the law down on them.

Outside the court, Sinclair said that he is targeting trash haulers who allow untarped garbage to litter the roadsides. The heaviest hit roadsides seem to be the approaches to the transfer station, he said, including Burkesville Road and Edmonton Road.

Other routine matters routinely approved

Other routine matters including paying of bills and road work were routinely and unanimously approved.

The meeting was well attended with all members of the court present and Administrative Assistant Lisa Lee, Finance Officer Gale Cowan and Treasurer Barry Corbin of the Judge's office, County Attorney Jennifer Hutchinson-Corbin, Jailer Bug Knight, Sheriff Ralph Curry, County Roads Supervisor Jobe Darnell and Assistant Supervisor Lonnie Page; Adair County solid waste czar A.L. Sinclair; 911 Head Dispatcher Justin Claywell; Rev. Jessee Hagan and family, Mr. and Mrs. Randy Burns, representatives of Wayne Equipment and Holt Equipment, and a full complement of media representing local the local papers, internet magazine, and a radio station.
