LETTER: Ed Pipalski questions Transportation Cabinet decisions

Landowner on KY 80 at Russell Creek thinks Highway Department is being unfairly taking land and frontage by his business

Dear Ed:I would like to share the information I have obtained on the new KY 80/Russell Road bridge project with the public.

You may or may not know that in order to seize a citizen's property under condemnation proceedings (eminent domain) in Kentucky; the citizen's representatives must give their consent (explicit permission). In our case that is State Senator Vernon McGaha and State Representative Russ Mobley.



I pray the good citizens of Adair County will let their representatives know what they think of the Transportation Cabinet/s plan after I reveal some unknown details.
  1. The project will not change the current flow of the creek as the bridge height will be lowered at the west bank and raised at the east bank approximately six inches (6"). The water level will reach the road bearing surface of the bridge as it does now at flood stage. Demonstrated by the photographs of the most recent rains.

  2. The roadway will remain a two-lane road with two-way traffic. There will be an eight foot (8') shoulder on both sides of the roadway, however the western bank and the northeastern bank will have a guardrail ten feet (10') from the roadway's edge and the southeastern bank will have a guardrail twelve feet (12') from the edge of the road.

  3. Guardrail on both southern banks of the creek will extend perpendicular to the roadway (at right angles) twenty feet (20').

  4. The Transportation Cabinet will take twenty feet deep (20') of road frontage from the western bank property owners and the eastern bank's northern side property owner, however on the southeastern bank thirty feet deep (30') of road frontage.

  5. The current right of way would accommodate the construction leaving nine feet (9') on the far side of all guardrails. It is our opinion the taking of private property for this project is an abuse of governmental power by the Transportation Cabinet and is not necessary.

  6. As you know, Transportation Cabinet employees are protected employees under the Merit System. Whom are they protected from and why? They, protected employees, decide when our government will betray the purpose it was given authority for: to protect life, liberty and property by the people. Yet they are protected from both our elected representatives and us the electorate. Basically held accountable only to themselves.

  7. The photographs will say it all. The graphics show the edge of roadway, guardrail along roadway, guardrail perpendicular to roadway and additional ten feet at the rear of my truck. Contact your representative and let him know what you think of the plan..

New East 80 Bridge: Ed Pipalski questions land being taken

Business owner Ed Pipalski writes:
The new right of way will extend to the rear of the red truck through the woods. The guardrail will extend to the rear of the white car Note that oncoming traffic will have to cross the centerline and new shoulder to strike guardrail. Wrong side of road maybe? My deed calls for, and I'm paying taxes on, the one acre of land next to the creek, but the Highway Department tells me it belongs to them.

East 80 bridge: Survey marker shows elevation



2006-10-05 - East 80 at Russell Creek, Columbia, KY - Photo By Ed Pipalski. Poking around, bridge neighbor finds little known information about East 80 Bridge, including a geodetic marker and date bridge was built, rated, back then, at only 15 tons!
This U.S. COAST & GEODETIC SURVEY MARKER is imbedded on the outside piers of the old East 80 at Russell Creek, Columbia, KY bridge. Ed Pipalski took the photo, noting the elevation and the date of 1951. He says another sign, just under this one, notes the date of construction of the current bridge, 1932, and says it was rated for 15 tons. He said that today's trucks sometimes have gross weights many times that, and understands why a new bridge is necesssary. " Just the other day, when traffic was detoured to KY 80 from the parkway," he said. "Think about the pounding this bridge took from trucks that day. And," he added, "people tell me that traffic over the years, along with pressures from flooding, have moved and weakened the bridge."
