Doing Donuts Case: Murley pleads Not Guilty; Wilson fails to appear Brian Murley enters Not Guilty plea through attorney; bench warrant issued for Edward "Jay" Wilson after he fails to appear at arraignment; letter warning of possible forfeiture of bond for Wilson has been ordered to be sent to Murley, and was prepared today. Birkett and Burris arraignments scheduled for Wednesday, August 9, 2006 UPDATE: On August 4, 2004, Judge Elliott recalled the order for the bench warrant. Edward Wilson pleaded not guilty. To read the updated story, Click here Brian Murley, through a fax from his attorney, pleaded not guilty to charges against him at his arraignment in District Court Wednesday morning, August 2, 2006. But Murley's step son, Edward "Jay" Wilson, also a defendant in the same case, failed to appear. A bench warrant for Wilson's arrest was ordered by Judge Roger Elliott. Judge Elliott also order that a letter, prepared today in Adair County District Court, be written to Brian Murley warning of a possible forfeiture of Wilson's $5,000 bond, The bond is secured by a farm owned by Murley. Brian Murley did not appear, but his not guilty plea, entered by his attorney by fax, was accepted by Judge Elliott. Mr. Murley is scheduled for a preliminary hearing in Adair District Court at 10:00am, August 21, 2006. The Murley farm property was pledged as bond in both Murley's and Wilson's cases. Murley and Wilson face assault, 4th degree charges growing out of an altercation at Joey Burris' home, after Burris has "done donuts" with his Mustang car on the parking lot of the Murley's store, HWY 61 Country Mart, at Breeding, KY. Brian Murley's wife said Wednesday night that she would like for people to know how dangerous she considered the act committed by Joey Burris with his car. "We have above ground gasoline storage. If he had hit those tanks, no telling what would have happened." Brian Murley filed complaints against Joey Burris and a neighbor who came to his aid, Jason Birkett. Warrants were issued against Burris and Birkett. Birkett, a neighbor of Burris, had come to Burris' aid in the fight. Birkett and Burris were both charged with assault, 4th degree, and were released on $500 cash bonds. Both Burris and Birkett are scheduled to be arraigned in Adair District Court on August 9, 2006, at 9:00am CT. See Related Story: To see earlier story on case, Click here.
