Adair Fiscal Court report, regular June 13, 2006, meeting

Site acquisition for Adair Justice Center approved. Total of $592,500 nearly 1.5 times budgeted costs. $1.5 million initial bonds to be issued. Jeff Thomas is new director of Animal Shelter. Mandy Hagy new assistant 911 coordinator. Garrett Luttrell, Heather Evans, Cecelia Kollody, new part-time shelter workers. Ann Melton tells court of need for two new polling places in First District, for one in Glens Fork. Sheriff succinct. Bids awarded. No action on Children at Play signs. Frances Drive discontinuance process begins with Richie Janes and Terry Partin as viewers.

In last night's successive meetings of Adair County Fiscal Court, the Adair County Public Properties Corporation, and the Adair County Project Development Board, the big news was the approval of the negotiations for the site for the Adair Justice Center.

The total price tag of $592,500 is almost 1.5 times the original budgeted $419,000 for site acquisition. Owners of First Realty are to receive $290,000; owners of Adair Florist are to receive $165,000, and $137,500 will be paid for the Adair Muffler site.


Signed agreements are in place for First Realty and Adair Florist, and Judge Vaughan said he needs only a signature to complete the Adair Muffler acquisition.

Issuance of $1,500,000 in principal bonds authorized

Meeting as the Adair County Public Properties Corporation, Adair Fiscal Court authorized the issuance of the first bonds for the Justice Center project. The total amount in the initial sale is $1,500,000. Site acquisition costs will come from this sale.

Jeff Thomas is new animal shelter director

Jeff Thomas approved as Director of the Green River Animal Shelter at $10.00 an hour. He will replace Debra Shaw, who resigned. Shaw was the shelter's first director.

Several other new employees were added. They are 911 Assistant Coordinator Mandy Hagy, at $9.00 an hour; Jimmy Blair as PT Jail employee at $7:00 an hour; Gary Luttrell, PT animal shelter employee, $5.50 an hour; Heather Evan, PT at animal shelter, $5.50 an hour, Cecelia Kollody, PT at the animal shelter, $5.50 an hour.

Judge Vaughan said that the animal shelter does better with more part-time employees, fewer full-time.

It was the 'Jesus wept' of sheriff's reports

Sheriff Steve Cheatham has become downright succinct in his latest reports to the Adair County Fiscal Court. At the last night's meeting, he said, "We had some franchise tax collections for May. $15,288.30. That's all I have," and said no more.

As he was finishing "That's all," a motion was made to accept the report, it was quickly seconded, and then approved 6-0. The Sheriff's tax settlemen was accepted, as well, 6-0.

Cable actions

The court unananimously approved the second reading of the Cable Ordinance and approve a resolution allowing the transfer of the cable system from Charter Cable (through New Wave Communications) to Duo-County Telephone Cooperative. Barring any unforeseen hitch, the sale will be complete and Duo-County will be in charge by July 1, 2006.

Road Aid Co-op Program approved

The magistrates voted 6-0 to approve the Road Aid Co-op Agreement with the Kentucky Transportation Cabinet. By so doing, the county will receive funds for manpower and material much faster than counties which do not approve the agreement. Adair County will receive 60% of the funds in August, 30 percent in March 2007, and the 10 percent at the end of the Fiscal year. Non-participating counties receive equal monthly checks.

Bids awarded

Several bids were opened, with Columbia Pharmacy receiving the contract for medicine at the Adair County Regional Jail, Hudson Materials receiving the bid for oils for chip and seal; Shofner Pest Control receiving the bid for pest extermination for the Annex, Courthouse, Restrictive Custody Facility, Adair Regional Jail, and Road Department; and Gaddie-Shamrock receiving the bid materials for blacktopping and road surfaces.

Industrial Authority delays report

Martin Jones, consultant for the Columbia-Adair County Industrial Authority (CACIDA) could not give his quarterly report because of the necessity to be in Atlanta, GA, with a terminally ill relative.

Jail reports $76,500 total billings

The Adair County Regional Jail reported $76,500 in monthly billings, less $18,264 for Adair County inmates, for a total outside billing of $58,256. Additional revenue included $1,578 in booking fees, $240 in inmate reimbursement for medicines, and $4,743 per diem paid by inmates, for a total to bill of $64,819. Jailer Wm. "Bug" Knight's jail report was approved 6-0.

Court approves discontinuance of Frances Drive in District 4

The court approved the discontinuance of County Road 1993, Frances Drive, in District 4 and approved the appointment of inspectors Terry Partin and Richie Janes. A hearing was set for June 26, 2006, at 9:00am, in the basement of the Adair County Annex.

Easement given to Adair Water District

The court unanimously approved granting of an easement to the Adair County Water District for a waterline crossing county property on Horseshoe Drive.

No action taken on discontinuing Children at Play signs

The court took no action on a request by Judge Vaughan to discontinue "Children at Play" signs. The signs present a liability, Judge Vaughan said, in that some people construe their meaning as "It's okay for children to play here."

County Attorney Jennifer Hutchison-Jones told the magistrates that the signs are legal. "They're not illegal," she explained, but they may present a liability."

Seventh District Magistrate Terry Farris took another position, "I've had folks in subdivisions tell me the how much the signs help"

But when no agreement could be reached, the matter was tabled.

New voting places needed at Glens Fork and in First District

Adair County Court Clerk advised the court of the need for new voting places for the Glens Fork and two precincts currently voting at Shepherd School.

Melton said that Darrell Grider had notified her that his business place would not be available for the fall election at Glens Fork, and the closing of Shepherd School would likely mean that the fall voting cannot be held there.

No action was taken at the meeting. But First District Magistrate Roger Stephens said that he would negotiate to find a location in the First District to replace Shepherd School as a polling place. Stephens thinks he can negotiate with Jeff Miller for voting at the new gate plant in just north of Shepherd Elementary School on KY 206.

Ann Melton said that she had contacted all churches and other possible Glens Fork voting places and had not found a new location there.

She suggested that the county might want to consider polling places like the new one at Gradyville, where a little building specifically for voting was built for approximately $3,500.

Clerk and County Attorney say county cannot refund on tax-bill purchases

Mrs. Melton also clarified the laws on purchase of county property tax bills, citing a recent effort by one tax bill buyer to get a refund on an uncollectible one. County Attorney Jennifer Hutchison-Corbin said that it is not the responsibility of the county, in any way, to help tax bill buyers with collection.

Court adjourns, reconvenes as Adair County Public Buildings Corporation

Near the end of the regular session of Fiscal Court, the court adjourned and reconvened as the Adair County Public Properties Corporation. (ACPPC).

Officers elected were Chairman Jerry Vaughan; Vice Chairman Wid Harris; Secretary Gail Cowan, and Treasurer Larry Dudley.

The officers were nominated by Fourth District Magistrate J.M. Shelley. The vote was 5-0, with Second District Magistrate Wid Harris abstaining so as to not vote on his own nomination.

Adair Public Properties Corporation approves issuance of $1,500,000 in principal bonds

The ACPPC approved the issuance of $1,500,000 in principal bonds. A large portion of this money will be used to buy the site location. This will take just over $600,000.

Adair County Project Development Board (PDB) approves purchase of site for justice center

Immediately following Fiscal Court and the ACPPC meeting, the basement meeting room was the site of a meeting of the Adair County PDB.

The PDB voted to accept the negotiated purchase prices for property at the corner of Campbellsville and Merchant Streets.

Signed agreements have been obtained for the First Realty lot and for Adair Florist, and a verbal agreement has been reached for the purchase of Adair Muffler.

The PDB voted to authorize the purchases and to give Chairman Jerry Vaughan the authority to sign the documents for all three, subject to the completion of paper work on Adair Muffler. The delay was caused by illness in the family of the owner, Judge Vaughan said.

The three properties will cost nearly 1.5 times the original estimate for the site. The site budget was originally $419,000. The total for the three lots will be $602,500.

It includes:
  1. First Realty lot: $290,000.

  2. Adair Florist lot: $165,000

  3. Adair Muffler lot: $137,500
A deal sweetener includes the option for the owners to salvage anything they want to before the sites are razed.

In addition to Judge Vaughan, the PDB members present and affirming all the actions of the board were Columbia Attorney Marshall Loy, First District Magistrate Roger Stephens, and Douglas Teague. Jeff Lillie of the Administrative Office of the Courts was also present as an advisor.

The next regular meeting of the PDB is set for June 27, 2006, at 5:00pm CT. At that time, DZL, the architects, will have more detailed plans for the Justice Center.

Routine matters routinely approvedRoutine items on the agenda, including minutes for May and June meetings, paying bills, road work, the financial report, budget transfers, and reading of roads were routinely approved, as were Court Orders, which included a $500 payment to Sheriff's Office Secretary Alice Stephens for extra work performed.

Third District Magistrate Tony Loy out-of-town

All magistrates except Third District Magistrate Tony Loy were present. Loy notified Judge Vaughan before the meeting he would be out of town.
