The Latest. Judge Vaughan on Justice Center: No decisions yet from landowners

Judge is hopeful. Deadline for acceptance or rejection is Friday, June 2, 2006 at 4:00pm. Landowners offer upped by 10% at May 23, 2006 PDB meeting. Total acquisition offer is $577,500. Owners will have salvage option on improvements. Next meeting date dependent of outcome of land negotiations.

Adair County Judge Jerry Vaughan said late yesterday afternoon that he remains hopeful that the landowners of the site for the Justice Center will accept the Adair County Project Development Board's (PDB) sweetened offer.

The deadline for a decision is Friday, June 2, 2006. So far none of the three landowners has given a final decision to accept or refuse the PDB offer, Judge Vaughan said.


At its last regular meeting, May 23, 2006, the PDB went into executive session to offer the three landowners 10% additional over the original MAI appraisal. The property sought is located at the corner of Campbellsville and Merchant Streets, and borders the Columbia City Cemetery.

Following the session, the PDB released the following new offers:
  • Realty office (Frost): Appraised at $250,000. Ten percent increase of $25,000 for a total package of $275,000

  • Florist (Mrs. Raines): Appraised at $150,000. Ten percent increase of $15,000, for a total package of $165,000

  • Muffler shop (Ford): Appraised at $125,000. Ten percent increase of $12,500, for a total package of $137,500.
The offer for the three lots needed, with the 10% increase, for the site is $577,500.

Authorization for increasing offer came at PDB meeting May 23, 2006

The authorization for increasing the offer to the landowners came in the PDB's May 23, 2006. meeting. The motion read, "The PDB authorizes the County Judge Executive and County Attorney to seek options on the preferred properties not to exceed ten (10) percent over the appraised value. The ten (10) percent additional expense is required to maintain the project budget. A ten (10) day window is being extended to sign option(s).

The wording for the motion was prepared by the Administrative Office of the Courts (AOC), and included a mild ultimatum in a note which read, "REASONING: The additional 10% required to maintain the project budget is to avoid condemnation."

The entire PDB board approved the motion, but local members privately said they have no heart for going the condemnation route. Besides Judge Vaughan, the chairman, the PDB Board includes Adair County Circuit Court Clerk Dennis Loy, Adair County First District Magistrate Roger Stephens, Attorney Marshall Loy, Circuit Court Judge James C. Weddle, and Douglas Teague, Administrative Office of the Courts.

Judge Vaughan said that the offer includes the right for the landowners to remove the buildings or parts of them as they choose.

Judge Vaughan would not comment on a report circulating in Columbia that an alternative site, from the Paul Turner (Shrader) Building on Fortune ST to the Grider Realty Office, was being promoted at a competitive cost of under $500,000.

Other action at the May 23, 2006, meeting

The board also heard a report from Amanda Ross of Ross, Sinclaire & Associates on interim financing for the project for the land acquisition and other costs prior to the issuance of the bonds.

Ross said that, depending on the needs, $1.25 million to $1.5 million can be delivered with the issuance of 2 year notes which will later be rolled into the bonds. Ross was accompanied by an associate, Wendell Emerson.

DZL Architects, Frankfort, was represented by Bill May and Michael Hesse, who told the board that they had no update, and could not have, until the site is secured.

Next meeting dates dependent on landowners' responses

The PDB board voted to set Tuesday, June 13, 2006, as next special meeting date if the land owners accept the latest offer. If they do not, the next special meeting will be Monday, June 5, 2006. The PDB's next regular meeting will be Tuesday, June 27, 2006. at 5:00 p.m.
