Adair Fiscal Court Report: February 13, 2006 meeting

Magistrates approve acquisition of Mack Tri-Axle Materials Hauling truck; legal sabers rattled at City of Columbia over raids on Deputy rosters; issue somewhat associated to City's failure to help on Cops in Schools budget problems. Hutchison-Corbin may take hard line with Mayor Bell, City of Columbia on officer raiding issue

The Adair County Road Department is getting a serious, big mother, materials hauling truck.

In yesterday afternoon's special regular January meeting, the Adair County Fiscal Court voted unanimously to order a Mack CV 713 Tri-Axle truck through the Worldwide Equipment Mack Truck Municipal Lease program.


The decision came after the court heard a presentation from World-Wide Equipment representative Jim Dotson.

Financing through Ross-Sinclaire & Associates, Lexington was approved. No money due from the county for six months, when interest could be--but does not have to be--paid.

The county will have a guaranteed buy-back of 91% of purchase price through J.M. Wood Auction Company of Montgomery.

The county does not pay Federal Excise tax on the purchase. This factor, plus special prices from Mack Truck Company, means the county could receive more for the vehicle when it is sold than was originally paid, Mr. Dotson said.

Thirty-three (33) other Kentucky local governments now use the program.

Road Superintendent Jobe Darnell said after the meeting that he expects the truck to be in service within two months.

Court plans to buy at new backhoe, road grader, trailer

The court also addressed other shortages in the county road department. A committee to be appointed by Judge Vaughan will recommend bid notices for a new road grader, a backhoe, and a trailer.

At present, the Adair County Road Department does not own a single backhoe. Two road graders are in the quarter century age, and one is totally inoperable.

The county had been offered Soil Conservation money for a backhoe, to be used to bury dead animals, earlier.

In a private comment, Adair County Solid Waste Coordinator A.L. Sinclair noted Adair County's lack of backhoe parity: "Do you know how many backhoes Pulaski County has?" he asked, and held up six fingers. "How many does Adair County have?" he asked, and made an index finger thumb "nil."

Good news from Adair County Court Clerk Ann Melton

The Court got good news from Adair County Court Clerk Ann Melton.Her office is returning $118,047.30 in excess fees to the county.Clerk Melton had projected a return of only $107,000 in her budget. She cautioned the court that some of the money, as much at $4,000-$8,000 might have to be spent for new buildings for voting in Little Cake and Eunice/Pellyton precincts.

And money comes back, briefly, from Sheriff's Department

Adair County Sheriff Steve Cheatham announced a return of $12,184.31 in excess fees to the county, after adjustments for a Purdue Pharma grant, but with a catch: The sheriff asked that the money returned be put in escrow to pay for the fourth year Cops in Schools program.

The program was funded for three years by the Federal government.

Under the original agreement, Adair County Fiscal Court and the Adair County School District agreed to pay for the fourth year of the program.

Sheriff Cheatham reported that Superintendent Darrell Treece assured him that the school board will honor their commitment.

Former Adair County Schools Grant Writer Sammy Taylor, who was in the gallery, said that he was sure the school system would honor the commitment.

Legal War Sabers rattled at City of Columbia

The Sheriff and County Attorney Jennifer Hutchison-Corbin said had asked the City of Columbia to help with the payments, since the schools are located in Columbia. So far, the City has refused, Sheriff Cheatham said.

Because of the attitude of the City, the county attorney said that she will now take a hard-line approach to another City-County dispute, this one over the trained personnel raids on the Sheriff's Department by the Columbia Police Department.

Deputy Sheriffs, contracted to the county, were lured to the City Police after the County paid for their police academy training.

"Case law and the statutes are on our side," Hutchison-Corbin said. The county attorney said that the conflict is primarily with Mayor Pat Bell, not with the city's legal department.

Jailer reports $65,926.00 billings for January 06

Jailer William "Bug" Night reported total Adair County Regional Jail billings of $65,926.00 for the month of January. Of that, $20,952 was for Adair County prisoners.

Three roads to be taken into county maintenance program

The court heard first readings for three roads to be taken into county maintenance program. They are 1) The Sandy Fork road in Magistrate Tony Loy's district, 2) the Ed Nell Rooks Road and 3) an extension of Ellis Road in Magistrate Roger Stephens' district.

County resolution requests "Agricultural Museum" status for Homeplace

The court unanimously approved a resolution requesting that the Kentucky General Assembly designate the Homeplace on Green River as a "Museum of Kentucky Agriculture." The Homeplace is located west of Highway 55 between Columbia and Campbellsville.

White Horse Road sign to be changed to Ten Gallon Road

First District Magistrate Wid Harris' requested that the sign for White Horse Road, off Liberty Hills Road, be changed to Ten Gallon Road. "The people's mail comes to Ten Gallon Road. I think our sign is in error," he said. The court approved the change unanimously.

Hatcher Construction payment approved

Magistrates approved the payment of $88,000 to Hatcher Construction for work on the Adair County Animal Shelter. The payment was the only item voted on in "Court Orders."

Gorman Shelley and County Auditors did not appear

Gorman Shelley of the Rural Secondary Program and the county's auditors had been scheduled to appear, but did not appear as expected. Judge Vaughan explained that the agenda items had been entered just in case they did want to appear.

Routine matters routinely approved

Routine items, including the minutes, bills, financial report, budget amendment, and budget transfers all received unanimous 7-0 votes.

The meeting was well attended, with all Magistrates present. In addition to the previously mentioned, also in attendance were County Treasurer Larry Dudley, Deputy Judge Gail Cowan, Payroll Clerk/Secretary Lisa Lee, Adair County Road's Department Assistant Superintendent Lonnie Page, Adair County Judge candidate Glenna Cowan, Second District Magistrate candidate Douglas Everett Campbell, Seventh District Magisterial candidate Jeff Bryant, and members of the print, web, and radio media.
