Sales tax changing for recreational vehicles

By Lisa Greer, Adair County Clerk

FOR: MOTOR HOMES, TRAVEL TRAILERS, FIFTH WHEELS, PULL BEHIND CAMPERS, POP-UP'S, "RECREATIONAL VEHICLES" - "This change will be effective July 1, 2023"

Recreational vehicles are now in the definition for "motor vehicles" . Pursuant to KRS 138.450(24) "Recreational vehicle" means any motor home, travel trailer, fifth wheel, pull behind campers, or pop-up camping trailer, which:

(a) Contains living quarters; and

(b) Is required to be licensed for use on the public highways.

This statutory change to the definition of a "motor vehicle" shifts the tax liability on the sale of recreational camper trailers from sales and use tax to motor vehicle usage tax.

Therefore, six percent (6%) sales tax on the sale of these specific recreational camper trailers is due at the county clerk's office at the time the recreational camper trailers are presented for licensing and titling as is the case with the sale of motor vehicles. This applies if buying from a dealer or from an individual in state or out of state. This law also mandates that these vehicles be plated, whereas before they did not have to be.

Previously, if buying a used camper trailer from an individual you did not have to pay the six percent (6%) sales tax nor plate said vehicle.
