Hazard, KY woman pleads guilty to theft of guardianship funds Former owner and operator of Mountain Serenity Inc., Hazard, KY was required to distribute state guardianship funds to residents; however, she instead used the funds as her own, according to Kentucky Attorney General Andy Beshear's office Click on headline for complete obituary By Terry Sebastian/Crystal Staley FRANKFORT, KY (Thu 22 Mar 2018) - Attorney General Andy Beshear and his Office of Medicaid Fraud and Abuse announced Thursday, that the former owner of a Hazard care facility has pleaded guilty to eight counts of theft. Donna Grigsby, 50, formerly of Hazard, KY, entered guilty pleas to multiple misdemeanor counts in Perry District Court March 20. The plea relates to Grigsby's ownership of Mountain Serenity Inc., formerly located at 490 Williams Branch Road in Hazard, KY, in December 2015. The facility was a Medicaid funded home providing care for elders and individuals with disabilities. As owner and operator of Mountain Serenity Inc., Grigsby was required to distribute state guardianship funds to residents; however, she instead used the funds as her own. According to the plea, Grigsby kept $450 from eight residents each, totaling $3,600. Grigsby has reimbursed the Commonwealth for the misappropriated funds. As part of her plea, Grigsby pleaded guilty to eight misdemeanor counts of theft by failure to make required disposition of property. She received a sentence of 12 months conditionally discharged (probation) for two years, and a requirement to pay a $500 fine and to repay $500 in investigative costs. Grigsby will be placed on the Kentucky Adult Caregiver Misconduct Registry for seven years. The registry is a database for employment reference for vulnerable adult service providers and individuals. The Office of Medicaid Fraud and Abuse of the Kentucky Attorney General's Office prosecuted and investigated this case with assistance from the Cabinet for Health and Family Services, Department for Community Based Services.
