ASL interpreter responds to Jim Harris letter Federal laws mandates services for hearing impaired, such as Communication Access Realtime Translation (CART), if it is requested Comments re article 83602 Jim Harris thanks for signing ASL at ACHS graduation By Anna Beard Mr. Harris, your thoughtfulness means a great deal to me and I appreciate you recognizing the importance of providing accommodations to those who require it. I had family attending the ceremony and graduating, so I provided my ASL interpreting services pro-bono to the school. I also graduated from ACHS in 2010, EKU in 2014, and I recently earned National Interpreter Certification (NIC) from the Registry of Interpreters for the Deaf. In regards to having Communication Access Realtime Translation (CART) services at a live event for those who are deaf or hard-of-hearing, the Americans with Disabilities Act (ADA) "Title II states that all services, programs, and activities of state and local government must be open and accessible to people with disabilities" and "Title III requires that all private entities dealing with the public- such as restaurants, theatres, and museums must be offered equally to people with disabilities." (Please reference kcdhh.ky.gov for more detailed information regarding your rights & the law and ASL Interpreting/CART services.) Therefore, as a hard-of-hearing individual, the school would be bound by ADA law and required to provide the CART services to you IF YOU REQUEST IT. As with any accommodation, if the school (or business) isn't notified that there is a need for it to be provided, how can they be responsible for arranging it? If you attend graduation (or any similar event) in the future, I encourage you to stand up for your access rights that have already been fought for.
