Jon Halsey: Comments on Gov. Beshear Statement About: Gov. Beshear's Statement on Marriage Licenses in Rowan County Not all statements submitted on this subject will be posted. This one is chosen because it meets our criteria for civil discourse at its highest levels. - EW By Jon Halsey Personal commentary In his Statement on Marriage Licenses in Rowan County Gov. Beshear said: "...I have no legal authority to relieve them of their statutory duty by executive order." His position echoes the official White House position "There's a rule of law and the principle of the rule of law is central to our democracy. And it's appropriate in this instance for a federal judge to determine the best way to enforce the law." While most agree with these sentiments and they are in fact germane to the principles guiding the formation of this Country, I can't help but wonder about the sincerity behind them. It appears the "Rule of Law" is a unpredictable and erratic at best. When the Attorney General of Kentucky refused to uphold the Defense of Marriage Act when it was the law the Governor and the Courts remained silent. When the Mayors and City Councils of so-called Sanctuary cities violate standing Immigration laws, there are no consequences. When the Attorney General of the United States refused to indict and prosecute armed thugs who intimidated elderly voters at the Polling places there was no consequence. When the President defies existing Immigration Laws, Welfare Reform Laws and even the legal requirements of his own Affordable Care Act, no action is taken. Equal justice under law is a phrase engraved on the front of the United States Supreme Court building in Washington D.C. It is also a societal ideal that has influenced the American legal system. It is based upon Fourteenth Amendment jurisprudence, and has historical antecedents dating back to ancient Greece. In this new Country it is now obvious that some are more equal than others.
