Judge Vance voids mayor election; orders Clerk to hold new one

The ruling by Judge Judy Vance is concise and easy to understand.

Judge Judy Vance has ruled in an order filed today, Friday, April 17, 2014, that the election of to the office of Mayor of Columbia on November 4, 2014 is declared VOID, and order that the Adair County Court Clerk, with the assistance of the Adair County Board of Elections, is ordered to conduct a new election for the office of Mayor of Columbia. The order did not set a date for the election.



'Errors in this election are voluminous and cannot be remedied'

In her ruling, Judge Vance noted that elections are not set aside for trivial reasons, and states in her opinion, "The Court is very mindful of the fact that the law supports and prefers that elections be upheld if at all possible. An election shall not be set aside for trivial causes, or in circumstances where the results of irregularities can be eliminated. Unfortunately, the irregularities in this case are voluminous and cannot be remedied."

Notes unfortunate position of Defendant Curtis Hardwick

Judge Vance made note of Defendant Curtis Hardwick's situation, writing, "The court is further mindful of the unfortunate position that the aforementioned irregularities created by this election has placed upon upon Defendant Curtis Hardwick. This court finds it disheartening and difficult to arrive at its conclusions when Defendant Hardwick stands completely innocent of any wrong-doing in this election."
