Deputy Co. Court Clerk, City Clerk file responses in Mayoral Contest case

City Clerk Rhonda Loy also files affidavit. Both filings took place on Thu 5 Feb 2015. Newest filings challenge status of four voters listed in 28 Jan 2015 filing, irregularities in the voting process for the 4 Nov 2014 general election for the City of Columbia, KY. The Adair County Board of Elections and City Clerk Rhonda Loy have filed a responses in the case of Ben Arnold, et al vs the Adair County Board of Elections, et al on Thursday, February 5, 2015 in regard to voters eligibility to vote in the City Election.



The new filing is in response to a filing by Elmer George, attorney for Ben Arnold, et al, filed Monday, January 28, 2015 citing irregularities in the voting process: Elvin Wright, Tina Johnson, Harold Warren, Angela Cowans, Starlett Johnson, William Burton, and Rose Burton, that they are registered voters in the City of Columbia and were not given a ballot to vote in the election. The eighth affidavit was from William Henson, who is not a resident of the City of Columbia, who was offered a ballot to vote in the election.

In the response, Nadalie Inscho-Asberry, Deputy Clerk in the Adair County Court Clerk's Office, stated as affiant: 1) That Elvin Wright, whose address is 1882 Campbellsville Road, Adair County, KY, is not eligible to vote in the City of Columbia Mayor's Race on November 4, 2015. 2) That Tina Johnson and Starriett Johnson voted by absentee ballot on October 23, 2014, and that both were coded to vote in the City of Columbia and the City Council race. 3) That Harold Warren, 1253 Campbellsville Road, Columbia, is not a City of Columbia resident and not eligible to vote in the City of Columbia Mayor's Raceand did not vote in the General Election held on November 4, 2014, and 5) That Ruth Ann Smith was coded to vote in the city races.

Rhonda Loy, City of Columbia Clerk, filed an affidavit on Thu 5 Feb 2015, stating that neither Elvin Wright nor Harold Warren is a resident of Columbia, KY.

A hearing in the case is set for 9amCT, Tue 10 Feb 2015, before Circuit Judge Judy Vance, in the Adair County Judicial Center, 201 Campbellsville Street, Columbia, KY
