Questions about proposed Occupational License Tax Ordinance

Who or what official/office is responsible for measuring compliance and enforcement of this ordinance? How will compliance against the standard (ordinance) to be measured?

Does compliance and enforcement efforts include:


Yard Sales with only like items such as, fishing poles, tools, ladies shoes or purses. Sometimes we see part-time weekend retail outlets posing as a yard sale. Kentucky says unlike items, less than $1000 gross annually and can only be operated occasionally (2 x per year).

Call in radio shows, when the host knows the person's first name and number, I suspect it is a business not an occasional private sale.

Does it include home businesses, Avon, Tupperware or the after hour auto repair or detail shop operated from a private home.

Does the private home then become commercial property and subject to commercial deed, tax and mortgage rates instead of subsidized homeowner mortgage subsidies?

What about transients? How is compliance measured?
Just appears to me, that raising or creating new taxes to meet revenue shortfalls from previous cash flow projections financially punishes those who are in compliance with the tax code and rewards non-compliant endeavors at the compliant's expense.

Shouldn't we first determine the "root-cause" of revenue projection shortfalls and establish a minimum baseline of compliance enforcing non-compliant operators before taking the default and easiest position to increase a never ending tax burden upon those legitimate and compliant operators?

Just a thought; from one with taxation without representation; I do believe at the founding of our nation, only property owners had the right to vote. There just might be wisdom in that notion, aside from any reprehensible and immoral clause. --Ed Pipalski
