Adair Fiscal Court Meeting, July 10, 2012

The Adair County Fiscal Court voted unanimously to approve a letter from Adair County Judge Ann Melton to Kentucky Attorney General Jack Conway, seeking clarification on the Adair County Hospital Board's stated intentions to re-instate a hospital tax to pay for a "shortfall" of debt which would survive the sale of the hospital to a For Profit group, LifePoint, from Nashville, Tennessee.


The letter asks these questions:
  1. What procedure should an existing taxing district with a zero tax rate follow to establish a new tax rate?
  2. With a previous tax rate of zero, how does 1979 House Bill apply to the Adair County Public Hospital's decision to establish a tax of 3.7 cents.
  3. If it is re-established to the previous 1997 rate of 3.7 cents, would such a rate be subject to recall?
  4. Is it within the statutes and law for the District to legally levy a tax for the first time in 15 years when it is also in the final stages of selling all of its assets? Taxpayers would be left paying a tax for years to come to a taxing district that will most likely have no assets and only exist to retire a debt.
  • While the vote was unanimous, it was not totally clear how the magistrates are aligned on the monumental issue now facing the county, considered by many to be the biggest debacle in the history of Adair County.

    The Adair County hospital board plans a public hearing on the tax on Thursday, July 19, 2012, and a Special Session on Friday, July 20, to enact the tax.

    Tommy Steele re-appointed to C/AC Parks & Rec Board

    The Court voted unanimously to reappoint Columbia/Adair County Parks and Recreation Board Member Tommy Steele to a new term ending June 30, 2016. Steele was recommended by the Parks and Recreation Board for approval by both the City of Columbia, which has already approved the appointment, and Adair Fiscal Court. At the request of the Parks & Recreation Board, terms of its members will all expire at the end of Fiscal Years.

    Judge Melton asked Harold Burton (1) to present certificates honoring three more Locks of Love Donors, Leslie Streeval, Sarah Streeval and Allyson Burton. All three are residents of Magistrate Burton's First Magisterial District. (Direct link to photo; also below

    Court approves agreement negotiated with Building Inspector

    The court unanimously voted to approve a settlement negotiated by the Building Inspector Committee, chaired by Daryl Flatt (2) and including Sammy Baker (3), and Joe Rogers (6), and presented to the court last night by Daryl Flatt. The vote was pending a contract with Building Inspector to be drawn up by County Attorney Jennifer Hutchison and subsequent approval by the parties for a contract including these points:
    1. There will be a signed 1 year contract
    2. The Building Inspector will meet with the committee at least every six months
    3. The rates charged will be the state rates for the duration of the contract regardless of changes at the state level
    4. The Building Inspector will document all visits to work sites
    5. Builders will contact the Building Inspector but checks will be made out to Adair County Fiscal Court, which will issue a check to the Building Inspector less 10% for bookkeeping, for each month's inspections
    6. Warnings rather than fines would be issued for first offenses related to the building code, with a cap on the amount of the penalty
    Magistrate Flatt said that the inspector, Carly Fudge, has agreed to the terms already.

    Court votes to publish 2011-2012 Audit in lieu of Full year end settlement

    The court voted to publish only the 2011-2012 Audit in a newspaper instead of publishing the full year end settlement report. Judge Melton said that a lot of money would be saved in so doing. The full year end settlement will be available for anyone's examination anytime during regular office hours. (The CJE's office staff was asked if the settlement will be online at the County's website, but no definite answer was given Wednesday, July 11, 2012, at 8:56amCT.

    Treasury has $812,874,16 at end of June, 2012

    County Treasurer Barry Corbin reported a reconciled balance in all county funds of $812,874.16 at the end of June 2012. He asked for and received approval for (now) routine fund transfers which might be needed for the jail, 911, and the animal shelter. The report and the request were approved in separate roll call votes, unanimously.

    Judge Melton said the county's year end report had been done more quickly than is usual, and was ready for submission to Frankfort by July 3, 2012 and commended the treasurer and the County Finance Office, Gale Cowan, for getting the work done so quickly. The year end report was approved unanimously, too.

    One court order approved

    A single court order to rectify a $45 overpayment in County Clerk Sheila Blair's settlement, was approved unanimously on a roll call vote.

    Sheriff's 2011-12 tax settlement approved

    The 2011-12 tax settlement from Sheriff Harrison Moss' office, prepared by Andy Coyle, was unanimously approved, as was Sheriff Moss' report. For the month of June, 2012, no taxes were collected he said, but he did give the activity report.

    Jail reports approved; second reading Policy and Procedures approved

    The court unanimously approved Adair County Jailer Rick Wilson's monthly and quarterly reports and the second reading amending the Jail's Policies and Procedures.

    For the month of June, 2012, the jail had gross billings of $77,810.04, minus Adair County's $30,117.74 costs, which, when booking fees, medical bills; per diem fees; home incarceration fees, and Cumberland County Medical charges, were added back in, left a total to collect of $54,740.31.

    Inmates furnished 3,292 hours of labor, at a value of $26,336.00 to Adair County Recycling, Adair County Road Department, Breeding Fire Department, Center on Aging, City of Columbia, Green River Animal Shelter, Adair County Pride (Litter pick-up), the Adair County Attorney, Columbia Sanitation, Adair County Food Pantry, and the Adair County Board of Education.

    Tracy Rooks, LPN, appointed to Adair County Ambulance Board

    Tracy Rooks, an LPN, was recommended by Judge Melton to replace Sherry Hutchison on the Adair County Ambulance Board and unanimously approved by the Court. Sherry Hutchison had asked not be be re-appointed, Judge Melton said. The Board oversees operations of the Adair County Emergency Medical Service (EMS). The vote for approval was 6-0 with Daryl Flatt (2) abstaining.

    Three re-appointments to the Columbia/Adair Airport Board

    Judge Melton recommended, and the Court unanimously approved, the reappointments of Mike Mitchum, Buddy Sewell, and Chris Janes to the Columbia-Adair County Airport Board. The terms are for four years, ending March 2016.

    Court approves Code Red for 911 warning calls

    On the recommendation of Judge Melton and Adair Emergency Management Director (EMD) Greg Thomas, the court unanimously approved a four year contract to utilize Code Red for warning calls to residents in case of an emergency. The cost of the four-year contract, $20,830 represents a savings of 15% compared to annual payments, Mr. Thomas said. Thomas noted improvements over the county's One-Call system, and said that the public has been enthusiastic about the calls. "We've had a lot more people call asking to be added to the list than we have asking to be removed." He said that the system will now send calls to mobile phones as well as land line phones.

    Reading of Roads by Lisa Greer in absence of 911's Justin Bailey

    Lisa Greer presided over the reading of the roads, usually handled by Justin Bailey, Adair County 911 Addressing and Mapping Coordinator, who was unable to attend.

    The court approved:
    • In District 1 (Harold Burton) - Second reading Adding Lincoln Drive off Liberty Road to County Maintenance.
    • In District 2 (Daryl Flatt) - Second readings to establish Elizabeth Drive off Greenhills as private passageway, 25 MPH limits on Coppage Road and Birch Road, and to place a Stop sign on Birch Road
    • In District 5 (Billy Dean Coffey) - Second reading to add Emerald Drive off Greensburg Road to county maintenance
    • In District 6 (Joe Rogers) - Second reading to adding Tulip Lane off Robertson Road to County Maintenance
    All the votes were unanimous, by roll call votes on each individual measure.

    A.L. is fed up with illegal trash disposal at Mt. Carmel

    County Solid Waste czar A.L. Sinclair told the court that something needs to done to stop some residents in the Mt. Carmel Boat Ramp area from dumping household refuse in and around the litter barrels at the park. He said that the barrels are intended for picnickers and boat traffic, not in lieu of regular household garbage pickup.

    Sinclair said that he can almost always find the source of the trash, and asked the court to consider, also, surveillance cameras at the scene.

    County Attorney Jennifer Hutchison-Corbin said that the fine for criminal littering is up to $500, and suggested a special county ordinance pertaining to the issue.

    Sinclair also announced the close of the Spring roadside cleanup work. with 362 miles cleaned and a total of 2,132 bags picked up. The department has enough money left in its budget to do another round of Fall roadside cleanups, he said.

    Sinclair also announced a successful grant application for Hazardous Household Waste disposal, in the amount of $20,000. With the money, household chemicals and paints can be accepted for proper disposal by his department.

    Sinclair said that he and the Nuisance Committee plan a trip to Somerset, KY, to see a model recycling center, preparatory to applications for a grant to build a new, larger recycling center. Magistrate Billy Rowe said that the Recycling Center is simply outgrowing its Service Road faciilty.

    The vote was made with the approval of the "Bills and Additional Bills" item.

    Court approves second reading of 911 Policy & Procedures

    The Court unanimously approved the Second Reading of the 911 Policy & Procedures Manual without further discussion.

    Court approves second reading of ordinance pertaining to policy for spending

    The court unanimously approved a second reading of an ordinance pertaining to its policy for spending resources and classification of fund balance. The policy states, among other things, "Adair County, when both restricted and unrestricted resources are available for spending on a specific issue, those resources considered restricted will be spent first." The vote was routine and unanimous.

    Court approves second reading repealing Synthetic Marijuana ordinance

    The court approved, on a motion by Joe Rogers (6) seconded by Billy Rowe (7), the second reading to repeal Ordinance No. 05-1A, the Synthetic Marijuana ordinance. The vote was unanimous. A state law already in place makes the ordinance redundant.

    Court approves Minutes for three meetings

    The Court routinely and unanimously approved minutes for three sessions, the regular session June 12, 2012; the special session June 14, 2012, and the special session for June 29, 2012. The approvals were made in three separate roll call votes.

    No action taken following Executive Session

    No action was taken following a very brief Executive Session based on KRS 61.180(B), having to do with sale or purchase of property.

    Storm Clouds or Rays of Hope?

The Historic Courthouse glistened in the evening sun before the regular meeting of Adair Fiscal Court, last night, but clouds added a foreboding, reflecting the worsening financial situation the hospital finds itself following a downward spiral of hospital utilization in the past 12 months under the management of Spectrum HealthCare Partners, overseen by the Adair County Hospital District Board. The court voted, unanimously, to seek Attorney General's opinions on the legal issues surrounding a proposed hospital tax which would survive the sale of the hospital to a For Profit group from Nashville which will leave a "shortfall" for the Hospital District.
