Trooper B.J. Burton enters not guilty plea at arraignment Kentucky State Trooper B.J. Burton, indicted by an Adair County Grand Jury last week, entered a plea of not guilty to a single charge of reckless homicide at his arraignment this morning in Adair Circuit Court. In a packed courtroom, Judge James G. Weddle set a preliminary hearing for Tuesday, October 23, 2007 at 1:00pm CT. A jury trial date was set by Judge Weddle for Monday, December 3, 2007, at 9:00am. Burton had been indicted by the Adair County Grand Jury on August 21, 2007, following the death of Billy Phillips, who died at 2:39pm CT, Monday, June 4, 2007, in the University of Kentucky Medical Center at Lexington, KY. where he had been airlifted to Lexington following severe injuries sustained at the Adair County Regional Jail on Friday, June 1, 2007, while in the custody of Trooper B.J. Burton. Mr. Phillips died at 2:39pm CT, today, Monday, June 4, 2007. Mr. Phillips was in the University of Kentucky Medical Center at Lexington, KY at the time of his death. He had been airlifted to Lexington following severe injuries sustained Friday, June 1, 2007. Trooper Burton was represented by attorney Stephen C. Schroering of Louisville, KY. A special prosecutor, Eddy Montgomery, has been appointed in the case. He is the Commonwealth's Attorney for District 28, which includes Lincoln, Rockcastle, and Pulaski Counties.
